THESE ARE THE TERMS for THE HOOLEY COLLECTOR CAR AUCTION
All articles are sold "AS IS WHERE IS" and with no warranties or guaranties of any type either
expressed or implied made by BARTEL & COMPANY. In no event shall the auctioneers, any employee,
agent or associate of Bartel & Company be responsible or liable for any such warranties, guarantees or
the description of any article offered for sale. Ask questions, seek information before you bid.
All statements in print as well as verbal statements made by the auctioneer or staff have
come from the Seller and are accepted as reliable. Bartel & Company assumes no responsibility or
liability for representations made by Sellers and shall have no obligation to verify or authenticate such
statements or claims. Any announcements made from the auction block shall take precedence over any
printed information in the catalogues, ads, brochures, signs and car cards.
Unless the sale of an article is advertised or announced to be otherwise, each lot is offered
subject to the reserve price of the Seller. When an article is sold with reserve, the auctioneer may bid on
the Seller's behalf in an amount not to exceed the reserve price of the seller.
Payment for any purchase shall be made directly to Bartel and Company Auctioneers Escrow from the Buyer today.
All payments must be made with good funds that are defined as cash, cashier's checks, wire transfer and certain credit
cards with added fee or personal/company checks approved by the auctioneers and or seller. No article can be
removed from the premises before settlement is made. Title and or article for any titled article purchased may be
retained on auction site, at seller’s and or Auctioneer’s discretion until Buyer's funds clear the Seller's or Bartel &
Company’s escrow bank account.
Once settlement is made, The Buyer at Buyer’s expense shall remove all articles from the sale area. Once the
auctioneer has declared the article sold, then the buyer shall be responsible for such item starting at that time.
All vehicles will remain in secure fenced area unitil pick is made. We would like all vehicles to be picked up and shipped out by June 25, 2023.
Once your bid is placed and recognized by the auctioneer it is irrevocable and then if the
said item is declared sold and your bid is the final one, you must pay your bid and settle for the same as described above.
All terms of sale posted on the auction premises, printed in sale brochures, forms, signs,
publicly announced, or otherwise published are incorporated herein by reference.
If any check given in payment is dishonored for any reason, (including but not limited to
insufficient funds, stop payment, no signature or the like), then Buyer agrees, whether such check is
given by buyer as maker or endorser, that if such check is placed in the hands of and attorney for
collection, to pay all reasonable attorney fees, as well as any collection or bank service charges
incurred, together with all court costs and any associated expenses in the collection of payment.
Buyer shall pay any sales taxes due or resulting from Buyer's purchase. We will collect collect 7% Indiana Sales Tax at the point of sale (today) from any purchaser who is NOT a licensed dealer regardless of their State of Residence.
All Sellers agrees to provide Buyer with good, clear and merchantable title and agrees to correct any title defects and/or pay the costs associated with providing the Buyer with good, clear and merchantable title as required by the State where the Buyer seeks to register the vehicle.
Sellers and buyers agree that Bartel & Company shall have no liability for loss, theft or damage of any type to the vehicle, its contents or components. Sellers, Buyers and Spectators further agree to save Bartel & Company, it's agents and it's employees harmless from any claims for personal injury and property loss or damage arising from attending this auction. Sellers shall maintain their own insurance. Bartel & Company provides no such insurance and is not an insurer of any vehicle or other article offered for sale.
Buyers agree to pay a 10% buyer’s premium for onsite bidders and 15% for online bidders to Bartel & Company on any vehicle purchased at this auction. The buyer’s premium will be added and paid in addition to the final bid (hammer price) of the vehicle at the auction. There is no charge to receive a bidder card in order to bid at this auction. Buyer agrees to pay a buyer’s premium as posted to Bartel & Company for any item in the Memorabilia auction segment.
