All items are sold "As Is" / "Where Is". Bidders are encouraged to, and acknowledge they can, inspect the Equipment and are not relying upon any photos, videos, representation, statement or other assertions made with respect to the Equipment's condition. Bidders are relying upon its own knowledge regarding the Equipment and/or its own examination of the Equipment. Bidders take the Equipment knowing there are no express or implied warranties given on the Equipment. The Auction will be conducted by offering the items by lot, either individually or in groups. The bidder offering the highest bid accepted by the Auctioneer shall be the purchaser of the offered lot, and no purchaser shall retract his bid. Purchaser accepts a lot when he makes a bid. All sales are final. All lots are sold pending sellers confirmation. Confirmation will be given no later than 24hrs after closing. Please allow up to 30 days for lien release (if necessary) and transfer of title. Currency Type: USD Payment Instructions: Wire transfer is the preferred method of payment. If the Auctioneer agrees to accept a payment via credit card, a 3% credit card fee may be assessed. Sales tax may apply unless you have an Oklahoma Agriculture Tax Exempt Card or a Resale Number. If the Payment Due is not received within 48 hours after the conclusion of the auction, the bidder unconditionally authorizes the Auctioneer to charge any credit card on file for the amount due. Bidder agrees that insufficient available funds to pay the full Payment Due shall not be a valid defense for non-payment. An Auction Lot that calls for financing will require the Bidder to enter into an agreement with complete terms and conditions. NO CREDIT CARD CHARGEBACKS: Each Bidder agrees to NOT, under any circumstances, initiate a credit card chargeback with respect to any charges. Bidder further agrees that if Bidder initiates a credit card chargeback, upon Auctioneer’s demand (1) Bidder shall withdraw such credit card chargeback and request the credit card issuer to re-credit all amounts to the account of the Auctioneer; and (2) Bidder shall be responsible for all costs and expenses, including but not limited to any attorney fees incurred by or on behalf of the Auctioneer, in challenging the credit card chargeback. South 99 Equipment is not responsible for internet failure or any disruption in internet service. All items are sold "AS IS-WHERE IS" without any guarantees or warranty expressed or implied, statutory or otherwise of any nature whatsoever in respect of the lots offered at the auction. Specifically, but without limitation, Auctioneer makes no representation or warranty that any of the lots conform to any standard in respect of safety, pollution or hazardous material, or fit for any particular purpose. The Auctioneers, sellers, or any member of their staff make no guarantee as to the authenticity, of any particular age, year of manufacture, model, make, mileage, hours, condition, or defect of any lot or item being sold. Bidders are encouraged to make their own physical inspection and rely solely on that inspection before bidding. Failure to inspect does not negate that Bidders responsibility to perform under the auction terms and conditions. Any dispute arising as to any bidding shall be settled by the Auctioneer at his sole discretion, and the Auctioneer may put the lot in dispute up for sale again. Auctioneer reserves the right to refuse any bid, which it considers to be an insignificant advance over the preceding bid. Certain items in the sale are being offered subject to reserve, which is the confidential minimum price below which such lot will not be sold. The Auctioneer has the right to place a bid for the consignor up to the Lot's reserve. Lots that fail to meet the reserve price may be represented for sale in another auction. Purchaser is responsible for insuring his purchases immediately. South 99 Equipment shall not be responsible for loss, damage, or theft of any purchase. Purchaser shall not be entitled to remove any item from the site until all his purchases are paid for in full including all applicable goods, sales or use taxes. Removal of all items shall be the sole responsibility of the purchaser. Loading assistance is provided as a courtesy; however, the purchaser assumes all risk and responsibility for loading and removal of purchases. Auctioneer reserves the right to require proof of adequate insurance coverage from any purchaser items requiring dismantling, rigging or hot cutting. Purchaser agrees to indemnify and save harmless both, consignor and Auctioneer, its officers, directors, employees, agents, and attorneys against any damage caused by the acts of purchaser.
