All bidders who participate by bidding in this auction agree to the terms and conditions of sale and agree to be bound by same. Any notices, posted or oral, during the sale, are also part of our terms and conditions of sale agreement. Acceptance of a bidder card or a bidder number constitutes acceptance of the following terms and conditions of sale.
All persons bidding in electronic format are responsible for reading, understanding and complying with the terms of sale as specified herein and agree to be bound thereby. Upon registering or making a bid to the auctioneer, buyers agree and accept the following terms and conditions. If you do not accept these terms and conditions, do not bid.
1. BUYERS PREMIUM - A seventeen (17%) buyer's fee will be added to each successful bid. Sales Tax: Sales tax is charged on all invoices unless paying by check (then in-state only sales tax applies) 6% PA sales tax.
2. All items come with a 30-day return policy for authenticity. Sellers remorse does not constitute a reason for return. After this time, funds will be released to the consignor and returns will not be accepted.
3. RESPONSIBILITY OF BIDDERS: Be sure to ask questions BEFORE bidding. Although we do our best to provide our best descriptions, you are strongly urged to inspect each item on which you bid, & to base your bids on your observations and opinions. Marburg Auctions is not responsible for any errors or omissions occurring in descriptions.
4. Disputes under this contract - Buyers & Marburg Auctions agree to mediate any dispute or claim arising between them resulting from the buyer participating in the auction or any resulting transaction. Any Mediation fees will be borne equally by each party. All mediation, arbitration & court shall be filed and conducted solely within York County, State of Pennsylvania and not in any other jurisdiction.
5. Announcements: Announcements may be made on the day of sale to clarify catalog descriptions or other information specific to a lot or individual property/merchandise item. These announcements take precedence over catalog information pertinent to the property/merchandise but do not alter in any way these basic terms and conditions of sale.
6. Addition or Deletion From Sale: Marburg Auctions reserves the right to withdraw from sale any of the items listed, to sell at this auction items not listed to group, subdivide lots or re catalog items.
7. Online bidders must be registered buyers with Proxibid. Each registered bidder is solely responsible for the use of his/her bidder number and any use by another person is presumed to be with the consent of and contractually binding on the registered bidder
8. Online bidding is provided to assist in the auction process. Online bidding has inherent risks including possible failure/delays of internet, wifi, software and more. As a bidder, you acknowledge the online bidding platform may or may not work as intended the day of auction. At no point or under any circumstances shall Marburg Auctions, LLC be held responsible for such (above-mentioned) failures/delays if they should occur. The use of a maximum bid during pre-bidding (at least 24 hours prior) through the online proxy-bidding feature should be utilized to ensure acceptance of bid.
