SALE ANNOUNCEMENTS: Announcements the day of the sale take precedence over all printed matter and advertising. Accepted forms of payment: Wire Transfer. Internet/absentee bidders: Payment is due within 2 business days of the close of auction. For example: if it is a Saturday auction then the payment is due by end of business on Tuesday. ON-SITE BIDDERS: All purchases must be settled for on Sale Day by Cash, Cashier's Check or Company and Personal Checks. All checks should be made payable to Elite Auction Co SALES TAX: All Sales will be subject to State and Local Sales Tax Laws. A valid farm tax number or resale number is required to remove tax—State of Oklahoma rule not ours INTERNET BUYERS PREMIUM: $1-$2500 10% ---no cap $2501-$5000 8% -- no cap $5001-$10000. 6% -- no cap $10000 and up. 4% -- $2000 cap Shipping Instructions: Buyer is responsible for all shipping logistics and costs. Elite Auction Co and/or its employees will assist with loading/unloading your equipment within the specified loading period. Disassembly, dual removal, etc is the responsibility of the buyer but we will assist with the process however we can. We are not responsible for securing loads. Loadout times: Assisted loadout will be available from Aug 17 (sale day) to the following Friday Aug 23 from 9-5 each day. After Friday Aug 23 it will be by appointment only. NO WARRANTIES: All sales are AS-IS, WHERE-IS, and with no warranty expressed or implied. Bidder has had the opportunity to inspect all sale items and bidder agrees to solely rely on his inspection. All sales are final. Bidder will not be entitled to any adjustment, allowance, or damages or any other remedy regarding the condition of any item purchased. AUCTION SITE: ALL BIDDERS AT THE AUCTION SITE ARE THERE AT THEIR OWN RISK. Bidder agrees the auction site is potentially dangerous because of heavy equipment operation. Regardless of cause, Auctioneer or its agents will not be responsible for any injury to anyone at the auction site. RISK OF LOSS: Once auctioneer accepts the highest bid, any item is then sold. Buyer then takes delivery and assumes all risk of loss for the item and buyer agrees to obtain full liability insurance coverage for the item as may be required by law. TITLES: Titles are not available on sale day and will be mailed to purchaser approximately 10 business days after satisfactory settlement. No titles will be available if vehicles are marked 'No Title'. Please be aware that in Oklahoma many trailers are not required to have titles and don’t just assume it has a title. If it is not clearly marked please ask or listen to the auctioneer when the piece is selling—he will announce if it has or doesn’t have title. All property is sold "AS IS", and ALL SALES ARE FINAL - BE RESPONSIBLE & PAY FOR YOUR MERCHANDISE. Property is open to public inspection during business hours. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinate factor. In no event shall the auction company be held responsible for having made or implied any warranty or fitness for a particular piece of equipment. Bidder shall be the sole judge of value and condition. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. Auction Company will not be responsible for any errors or omissions in the description of the merchandise. BIDDER AGREES that everything is sold AS-IS and that they MAY NOT RETURN any item they purchase. The auction company is providing Internet Pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Elite Auction Co or anyone else if the Internet service fails to work correctly before or during the live auction. The auction company will not be responsible for any missed bids from any source. The auction company reserves the right to withdraw or re-catalog items in this auction. Buyer is responsible from time of sale and will not hold the auction company responsible for any liability, resulting from theft, accidents, or fire. All items to be paid for BEFORE removal from this auction yard. Announcements made Day of Sale supersede all printed material. Descriptions and hours are believed to be correct, but not guaranteed. We represent the equipment to the best of our ability but we are human & do miss things from time to time so please come inspect for yourself BEFORE you bid. When you bid, you are accepting our inspection as your own if you haven’t looked beforehand.
