All successful online auction bidders agree to make full payment to Air Works Consignment Auction LTD Within 48 hours after the auction date. All credit cards on file with a purchase under $2,000 will be processed within 24 hours of the auction event, and an additional 3.9% card fee will be charged. If you spend over $2,000, you will be asked to send an alternate payment method at the auction company's discretion. Suppose you are coming to pick up your items the week after the auction, and your total is over $2,000. In that case, you will asked to send a wire transfer for your purchases before picking up your items or bring a certified check along, as all items need to be paid before leaving the auction site. Immediately Available Funds: Bidders' bids are not subject to financing. Bidder represents and warrants to Air Works Auction that such bidder has immediately available funds to fully pay for it’s successful bids within (48) hours of the auction date.

Fraudulent Bidders/Unpaid Invoices: Air Works Consignment Auction LTD reserves the right, and you acknowledge and agree to its exercise of its right, to notify third parties, including law enforcement authorities, credits bureaus, other auction companies and industry regulators and authorities, about Bidders involved with or connected to fraudulent bidding or failure to pay invoices in accordance with these Auction specific terms fully. Liability for Bids: Any bidder, participating on behalf of their employer or acting as agent on behalf of a principal and/or principals, whether bidding, buying, attending, or otherwise, agree that such actions shall constitute sufficient evidence that such Bidder is authorized to bind such employer and/or principal. Please Note; we are required to collect local sales tax on most auctions. If you Have a tax ID number and are tax-exempt, we ask that you put it on file with Proxibid. Any titled vehicles will have the sales tax removed from the invoice and you will remit the tax when you register the vehicle. If your payment is processed through AtgPay, they collect and remit sales tax. We have no control over this, and you must have a sales tax form on file with them. Air Works Consignment Auction will not give refunds on sales tax, they must be processed from AtgPay specifically. All items are sold 'As Is Where Is' The Air Works Consignment Auction Ltd. acts only as an agent of the seller and assumes no responsibility for seller statements. All items sell as is where is with no warranties or guarantees. Buyers are encouraged to inspect items and equipment before bidding on them as the winning bidder is committing to a legally binding purchase. We have good, trusted sellers and ask the sellers to represent their items in an ethical manner but ask that you the buyer understand you are purchasing items and equipment upon your own final inspection and discretion. All items are to be removed from the premises by the purchaser. In all disputed bids, the decision of the auctioneer on the stand is final. The sales price is the price recorded by the clerk on the clerking sheet at the time of the sale. If you question this price, we will endeavor to check with the clerk and the auctioneer. However, if they don't recall the item or a difference in price, the price on the clerking sheet shall stand and you are expected to pay for the item. Purchaser assumes responsibility for items at the time of purchase (i.e., when the auctioneer declares the item sold). Do not leave items unattended. The buyer is responsible for picking up the purchased items during allotted removal dates and times. If you send a trucker to pick up your items, he must have a paid receipt or will not be loaded. No exceptions. Buyer’s will need to have a paid receipt to enter auction area and before loading. Free load out assistance will be provided till dates with each ring or department as listed below; Heavy Equipment, February 17th thru 28th, Sawmill Equipment February 17th thru 26th, Woodworking & Metalworking February 17th thru 21st, Dean Beachy Arena Building and Book Auction area items need to be removed by last day of sale Saturday Feb. 15th. Items in all other areas need to be removed by Wednesday Feb. 19th. Special pick-up arrangements will be considered for some items, call Mike 330-521-0275. Note; Online purchases from the antique and collectible rings will be sent to a third party shipper on same day that the item was sold, the third party shipper will contact you (the buyer) for shipping arrangements. After the above dates it's by appointment only and at a fee of $100 to $500 depending on load. To schedule an appointment for loadout after the above dates. Call Loadout Manager Mike Yoder 330-521-0275. Any items or Equipment left on the lot after February 28th 2025 will become property of the Air Works Auction. NOTE: The Auction reserves the right to sell or dispose of items left on the premises past the pick-up dates listed above. Send a copy of your paid receipt with your hauler. Buyer is responsible to arrange removal of items purchased. Buyer forfeits any item left on the auction site premises 14 days after the auction, to the auction company. No refunds will be issued. The lot is closed on Sunday.
