All persons attending the exhibition, sale or removal of merchandise assume all risks of damage to person or property and specifically release and indemnify Wilson Auction Service from any liability. 2. All property is sold AS IS and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the buyer's responsibility to determine condition, age, genuineness, value or any other determinative factor. Wilson Auction may attempt to describe the merchandise in advertising, on the Internet and at the Auction but makes no representations. In no event shall Wilson Auction Service be held responsible for having made or implied warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. All advertising is derived from sources believed to be correct, but is not guaranteed. 3. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Wilson Auction Service will not be responsible for any error or omissions in the description of the merchandise. Bidder agrees that everything is sold 'AS IS' and that they may not return any item they purchase for any reason. 4. Wilson Auction Service is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly on the day of the Auction. Under no circumstances shall Bidder have any kind of claim against Wilson Auction Service or anyone else if the Internet service fails to work correctly before or during the live auction. Wilson Auction Service will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged are encouraged to use the proxy bidding feature and leave their maximum bid 24 hours before the Auction begins. Wilson Auction Service reserves the right to withdraw or re-catalog items in this Auction. 5. The Auctioneer shall advance the bidding at his own discretion. Wilson Auction Service may withdraw any item before or during the Auction. Onsite Bidding wins over Online Bidding in instances where a 'tied up' or 'locked' bid arises. Auctioneer has final discretion in any disputes. The record of the Auction by Wilson Auction Service shall be conclusive. 6. When the Auctioneer says 'sold', Bidder assumes full responsibility for the merchandise. All Proxibid credit cards will be charged on the Tuesday following the sale. Payment shall be made by MasterCard, Visa, Discover, American Express, or check. Sales tax will be automatically calculated BY PROXIBID at the time of checkout based on a variety of factors including: State, City & County jurisdiction requirements, shipping to address, shipping from address and category of item purchased. Unless exempted by law, the purchaser shall pay any and all applicable taxes. Bidder agrees to indemnify Wilson Auction Service against any claim if sales tax is not collected on Bidder's purchases. Bidder agrees that under no circumstance will he/she initiate a charge-back on his/her credit card. 7. Packing, shipping and insurance costs are the responsibility of the buyer. Your shipping costs will be charged separately on your credit card. ALL FIREARMS WILL BE SHIPPED TO A LICENSED FEDERAL FIREARMS DEALER. NO EXCEPTIONS. Once items are shipped, you will be required to complete federal background check in order to receive your purchases. If you are denied for any reason, no refund will be given and firearms will be handled by Auction Company and or FFL Dealer. Please have your dealer email a copy of his/her license to guns@soldbywilson.com THERE ARE NO EXCEPTIONS TO THIS RULE!! Any questions, please call the auctioneer. Bidder agrees to provide any identification that Wilson Auction Service may request, including but not limited to: driver's license, photocopies of credit cards, Social Security card, or Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items. 9. Any and all disputes shall be venued and heard and decided in Saline County, Kansas. 10.
