Bidding is open to the public without regard to race, color, sex, religion, or national origin. All bidders must register prior to placing bid Bidders are required to be 18 years of age or older to place bids and must present a government-issued photo identification when registering to bid Bids may be placed online and will be represented at the Live Auction.  Absentee and Live Telephone bids are available.  You are encouraged to use the Max Bid feature which represents your high bid. Method, order of sale, and bidding increments shall be at the discretion of the auctioneer, auctioneer reserves the right to delete or add items at it’s discretion, and will act to protect the interest of the buyers and sellers as an agent, by bidding through the auctioneer, may open bidding on any item by placing a bid as an agent for any buyer or seller. Announcements (both verbal and written) made during the auction take precedence over all printed material or oral statements made, auctioneer has the authority and discretion to deviate from, change, alter, or modify, the bidding procedures and conduct of the auction even after the start of the auction by announcing those modifications at the time of the sale. Auctioneer has the right to withdraw any item, cancel the sale of any item(s) or cancel the entire auction without notice or liability to the auctioneer or its associates. In the event of technology issues with Internet sales, the Auctioneer reserves the right to reopen, extend Internet bidding or pause the auction, as it deems necessary and appropriate. In the event a bidder loses internet connection, immediately call the                                              Berger Truck Sales Office (434-429-7263) for assistance. The highest bid as accepted by the Auctioneer is considered the Buyer and the final bid shall be the buyers bid and final sale price plus all applicable fee’s. If a dispute arises between two or more bidders, the auctioneer reserves the right to re-open bidding, the auctioneer will determine the buyer and shall be final. The owner of any item(s) being sold may not bid on that item. BUYER’S PREMIUM:  A 10% Buyer’s Premium for on-site bidders and 13% for all online bidders will be charged for each lot purchased up to a $3500 Maximum Fee, in addition to any applicable sales tax.   APPLYING FOR TAX-EXEMPT STATUS: All taxable items are subject to a 6.3% Sales Tax Some bidders may be exempt from payment of applicable taxes. If you wish to apply for tax-exempt status, you must submit a completed copy of your tax-exempt certificate prior to this auction’s closing. Please note that you must declare that you are tax exempt when registering for the auction. If you do not follow the procedures discussed in this paragraph, the Auctioneer will be unable to consider identifying you as exempt from taxation, and you will have to apply directly to the applicable state for a refund. Payment Options:    Wire Transfer, Certified Check ,Cash(sale day ONLY),Credit Card($5,000.00 limit)    A 3%(Visa, Mastercard, Discover)or 4%(AMEX) processing fee added to credit card purchases. Maximum of $5,000 on Personal checks ( Must provide a bank letter with proof of funds) Lucky L reserves the right to disqualify any bidder whose credit card is denied for any fee charged during the auction. In the event a bidder is disqualified due to an inability to collect the appropriate fee, immediately call the office (434-429-7263) to take the steps necessary to reinstate their ability to participate. A $50.00 per day Late Payment Fee will be charged on any outstanding balance unless acceptable arrangements are made with the Auctioneer. Buyer (Winning bid) agrees to pay the amount of the final winning bid.  Failure to pay will result in prosecution in a court of law. The Buyer will be liable for any attorney/court fees associated. Buyer agrees to not issue a stop payment on any checks issued or initiate a credit card chargeback with respect to any purchases made at this auction. (Loadout fees may apply) Lucky L's and Berger's  personnel will not push, pull, or drive equipment or trucks onto trailers, stack trailers, or load large items. Buyer is responsible for arranging his own freight/transport of the item(s) and the Auctioneer is not responsible for any damages associated with transport. Storage Fee:  UNLESS PRIOR ARRANGMENTS ARE MADE!   Any item remaining after the Removal Deadline, a $10 per day, per item fee will be charged to the buyer until the item is removed. Anything remaining 60 (sixty) days after the Removal Deadline will be considered abandoned and the Auctioneer may take possession of the asset(s), and has the right to resell the item(s) The auctioneer reserves the right to prosecute the Buyer in a court of law for failure to abide by the terms and conditions set forth in this document. TITLES: Titles will not be released until all payments have been received.  Lucky L and Berger make every effort to release the title to the Buyer in a timely manner. The auctioneer or associates does not guarantee mileage accuracy, we list the odometer reading!    The auctioneer or associates are not responsible for any mileage discrepancies!
