TERMS AND CONDITIONS All bidders and participants agree they have read and fully understand these Terms and Conditions and agree to be bound thereby. Auction Conduct & Representation This auction is conducted by Cox Auctions & Realty, LLC, both on-site and online via Proxibid, for the liquidation of restaurant and kitchen equipment. Asset Condition - "AS IS, WHERE IS" All property is offered for sale "AS IS, WHERE IS" with no warranty, guaranty, or representation of any kind, expressed or implied, as to the merchantability, condition, or fitness for use. All sales are final upon the auctioneer's declaration of "SOLD." No refunds, returns, or exchanges will be allowed. Inspection All items are used and may contain defects not immediately detectable. Bidders are strongly encouraged to inspect all property prior to bidding. Inspection is available on Thursday, April 17th, from 11:00 AM to 6:00 PM. See item pages for details, if applicable. Buyer's Premium A 10% Buyer's Premium applies to all on-site purchases. An 18% Buyer's Premium applies to all online purchases made through Proxibid. These fees are added to the final selling price. Bidding Bidders may place pre-bids prior to the live auction. The auction will conclude with a live simulcast on April 19th, 2025. Seller reserves the right to reject any bid and withdraw any item at any time. Payment Terms All purchases must be paid in full before removal. Acceptable forms of payment include: - U.S. Currency - Cashier's Check - Credit Card - Wire Transfer (subject to a $15 fee) Payment must be received within three (3) business days of the auction's close unless otherwise agreed upon in writing. Removal of Property All property must be removed from the premises by close of business five (5) business days following the auction (unless otherwise approved by the seller). No property will be released without a paid-in-full invoice. - Buyers are solely responsible for all packing, loading, labor, and transportation of items. - Property may only be removed during normal business hours. - Under no circumstances will Cox Auctions & Realty, LLC or the seller provide loading or shipping services. Title Transfers For titled property (vehicles, trailers, etc.), titles will be issued upon full payment. Titles may carry restrictions as described in the asset listing. Default & Forfeiture Failure to pay in full or remove property within the specified timeframe may result in default. In such cases, the seller may reclaim and resell the property, and the buyer may be suspended from future auctions. The seller reserves all rights and remedies under applicable law. Sales Tax Applicable state and local sales tax may be charged unless the buyer provides proper exemption documentation prior to checkout. Buyers are solely responsible for contacting the appropriate tax authority and ensuring compliance. Employee Bidding Employees of the seller and auctioneer may bid on items in this sale. Limitation of Liability Persons attending the auction, inspection, or removal do so at their own risk. Cox Auctions & Realty, LLC and the seller shall not be liable for any personal injury or property damage incurred on premises.
