ALL PROPERTY is sold “AS-IS”, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determining factor. Bob Mitchell Auctioneers, LLC. May attempt to describe the merchandise in advertising, on the Internet and at the Live Auction, but makes no representations. In no event shall Bob Mitchell Auctioneers, LLC. be held responsible for having stated, implied or omitted information for any warranty of merchantability or fitness for a particular purpose. Bidder is responsible for and shall be the sole judge of value. Equipment and other items may be previewed at the Auction Site the week before the auction, up to Auction Date. We encourage Bidders to bring their mechanic to inspect, test and compare the equipment they have interest in bidding on.
Bob Mitchell Auctioneers, LLC. is providing Internet pre-auction and live bidding as a service to Bidders. Bidders acknowledge and understand this service may or may not function correctly on the day of the Auction. Under no circumstances shall Bidder have any kind of claim against Bob Mitchell Auctioneers, LLC or their employees and/or contractors, if the Internet service fails to work correctly before or during the live auction. Bob Mitchell Auctioneers, LLC. will not be responsible for any missed bids from any source. Internet Bidders who choose to make certain their bid is acknowledged, should use the proxy-bidding feature and place their maximum bid 24 hours before the Auction begins. Bob Mitchell Auctioneers, LLC., reserves the right to withdraw or re-catalog items in this Auction.
INTERNET BUYER’S PREMIUM:
• An Internet Buyer’s Premium of four percent (4%) will be charged on purchases up to $50,000 with a $2,000 cap. For purchases of $50,000 or more, a fee of $2,000 will be charged.
SALES TAX:
• Sales Tax is based on the address of the Auction and the percentage charged per that location.
• Sales Tax will be added to the purchase price of all purchases deemed taxable in accordance with Federal, State and/or Local Laws. Sales Tax will be added to the Buyer’s invoice, unless Buyer provides, a Texas Ag/Timber Number or Texas Resale Number at the time of purchase. No exceptions.

PAYMENT of INVOICE for ONLINE WINNING BIDDERS:
• The only form of payment accepted by Bob Mitchell Auctioneers, LLC. for online purchases is Wire Transfer by USD currency. Payment is due by 5:00 pm on the

CHECKOUT:
• All purchasers at the Live Auction or Winning Bidders Online, will be required to pay their individual invoice PRIOR to loading and removing items from the Auction Site.
LOADING, PICKUP and/or DELIVERY TRANSPORT:
• Winning Bidder/Buyer is responsible for pickup and removal of purchased items.
• A loader will be furnished at the Auction Site through April 24, 2025.
• If there are purchased items the furnished Loader Tractor can’t be used to load, those items will require trailers to be detach or have ramps to load. There is NO DOCK at the Auction Site.
LIVE and ONLINE SPECIAL TERMS of the AUCTION process. Some terms will be solely applicable to LIVE AUCTIONS, and others to ONLINE AUCTIONS. PLEASE read and understand the process for either attending the LIVE AUCTION or BIDDING ONLINE.
• The Auctioneers reserve the right to refuse any applicant a bidding card, the privilege of bidding at this Auction, and to revoke such privilege at any time.
• All descriptions of equipment in this catalog are believed to be correct. However, neither the owner, nor the auctioneers are responsible for any errors in description or conditions. The equipment is available to the public for inspection prior to the sale. The descriptions provided are merely a helpful guide and are in no way a warranty or guarantee, actual or implied. The Auctioneers do not guarantee year models or serial numbers. Any announcements made on the day of the sale by the Auctioneers, regarding the equipment in the sale supersede all previously printed or posted information and/or material.
• The Auction will be conducted by offering the items by lot, either individually or in groups. The Bidder offering the highest bid accepted by the Auctioneers, shall be the purchaser of the offered lot and no purchaser shall retract his bid.
• For Onsite Bidding, the Buyer is responsible for insuring items purchased from the moment their bid is accepted by the Auctioneers. Purchases at the Live Auction shall be paid by cash, certified check, personal or company checks accompanied by a bank letter of guarantee. Buyer will take immediate possession upon proper settlement. Buyers are responsible for taking responsibility for sales which are subject to state sales tax laws. Buyers may pay for their purchases at any time during the sale. However, all INVOICES MUST BE PAID BY THE END OF THE AUCTION. A copy of the invoice will be provided to the purchaser at the time payment is made.
• No equipment is to be removed prior to complete settlement for all items purchased has been made. Equipment may be removed after payment and with a valid copy of the paid invoice from the Auction office. Buyers are responsible for breaking down equipment for transport. In the event a Bidder fails to pay for an item, the Auctioneer may, at his discretion, treat the purchased articles as property of the Bidder and hold the item(s) in the Auctioneer’s possession. The Auctioneer also reserves the right to resell such item(s) without notice at the Buyer’s expense. The Buyer will be responsible for any expenses, loss or costs incurred from the resale of the item(s).
• Any dispute arising as to any bidding, shall be settled by the Auctioneer at their sole discretion and the Auctioneers may immediately, place the Lot in dispute up for sale again. The Auctioneers reserve the right to refuse any bid considered to be an insignificant advance over the preceding bid. Bidder/Buyer is deemed to have accepted a Lot when he makes a bid.
• There shall be no guarantee or warranties, expressed or implied, statutory or otherwise of any nature whatsoever. Every Lot will be sold “AS-IS”, “WHERE-IS”. Specifically, but not to restrict the generality of the foregoing, the Auctioneers make no representation or warranty that any of the Lots sold, conform to any safety or pollution standard, law or regulation, are fit for any particular purpose, are merchantable, able to be financed, or are of a particular age, year of manufacture, model, make or condition. Bidder agrees he has satisfied himself as to all matters relating to the items sold and is not relying on the Auctioneers, nor are the Auctioneers liable for any matter in respect of the above information.
• Auctioneers may at any time, at their sole discretion and without notice or liability to Bidder, withdraw or cancel the sale of any Lot or offer any Lots in groups or with privilege.
• No sale shall be invalidated by Buyer for any reason whatsoever. It is the Buyer’s responsibility to inspect each piece of equipment he is bidding on. Buyer must determine the condition of the equipment and bid according to his own judgment.
• If for any reason the Buyer fails to remove any Lot purchased, within the specified time for removal, the Lot shall be deemed abandoned and the Auctioneers, at their sole discretion, may resell, remove and store the said Lot at the Buyer’s sole risk and expense. In addition, Buyer shall be liable for any rent incurred or damages suffered by the Auctioneers because of the Buyer’s failure to remove the Lot.
The Bidder acknowledges the Auction Site is potentially dangerous place. Flammable, noxious, corrosive and pressurized substances are present. Heavy equipment is being operated, and electric circuits may be live. Every person at the Auction Site before, during and after the Auction Sale is at his/her own risk with after receiving notice or being made aware of the condition of the premises or the activities on the premises. No person shall have any claim against the Auctioneers, their agents, employees or principals, for any injuries sustained, nor for damages to loss of property occurring from any cause.
• No TITLES will be given out on the day of the Auction. Titles will be completed in the name on the Buyer’s invoice. There will be “NO OPEN TITLES”. TITLES will be mailed out by Certified Mail the latter of (1) ten banking days after the day of the sale, or
(2) ten banking days after payment for item has been received, unless other announcements have been made regarding the item.
• Pre-Bids placed will be executed by the Auctioneers, however, Auctioneers shall not be liable for any claims or costs arising from failure to do so. Pre-Bids placed on Lots passed or not sold due to reasons under the Auctioneer’s control will be automatically deemed null and void.
