TERMS & CONDITIONS – ONLINE AUCTION HOUSE Last updated: [December 11th 2025]?These Terms & Conditions govern all bidding, purchases, and interactions with [Ace Auctioneer LLC] (“Auction House,” “we,” “us,” “our”). By registering to bid, placing any bid, or purchasing any item, the bidder (“Buyer,” “Bidder,” “you”) agrees to be legally bound by these Terms. 1. BINDING CONTRACT 1.1. Each bid placed is a binding contract to purchase the item(s) if you are the winning bidder.?1.2. Registration, bidding, and purchases require acceptance of these Terms. Failure to read the Terms does not exempt you from compliance. 2. ALL SALES FINAL – NO REFUNDS, RETURNS, OR CHARGEBACKS 2.1. All items are sold AS-IS, WHERE-IS, with no warranties, express or implied.?2.2. No refunds, returns, exchanges, or cancellations are permitted for any reason.?2.3. Chargebacks or payment disputes are strictly prohibited. Filing a chargeback constitutes a breach of contract, and the Auction House may pursue: Collection actions Legal remedies Permanent account termination 2.4. Attempting to reverse a legitimate charge may result in: Additional fees Debt recovery via third-party collection Reporting to online auction platforms for removal 3. PAYMENT TERMS 3.1. Payment is due immediately upon auction close.?3.2. Accepted payment methods: [Wire, Cash on Pick up, Zelle, Venmo, Cashapp, Chime]?3.3. Failure to pay in full within 72 hours constitutes default.?3.4. Defaulting Bidders may face: Permanent ban Debt collection and legal action Loss of bidding privileges 4. PICKUP & SHIPPING 4.1 Pickup All won items must be picked up within [7 days] of auction close. A valid ID may be required. 4.2 Shipping Shipping is available through auction house Shipping fees must be paid in full before items are sent. Once shipped, the Auction House is not responsible for delays, damage, or loss caused by carriers. All claims are the responsibility of buyer. Buyer must contact shipper to file any an all claims themselves. 5. ABANDONED ITEMS 5.1. Any item not picked up within [7] days of auction close is deemed ABANDONED.?5.2. Abandoned items become immediate property of the Auction House, with no refunds or credits issued.?5.3. The Auction House may: Re-sell Dispose of Retain?the abandoned item at its sole discretion. 5.4. Buyers remain fully responsible for the invoice amount and any fees, even if the item is abandoned. 6. ITEM DESCRIPTIONS 6.1. Photos and descriptions are provided for informational purposes only.?6.2. The Buyer is responsible for examining all photos and details before bidding.?6.3. No guarantee is made regarding condition, completeness, functionality, or authenticity unless explicitly stated. 7. DISPUTES & LIABILITY 7.1. The Buyer agrees to hold the Auction House harmless against: Condition issues Misunderstood descriptions Buyer remorse Shipping delays Loss or damages after pickup or delivery 7.2. The Auction House’s total liability shall never exceed the amount paid for the item in question. 7.3 Item Availability & Auctioneer Error The Auctioneer reserves the right to cancel any sale, bid, or invoice in the event an item is unavailable, missing, damaged, withdrawn by the consignor, or listed in error. In such cases, the Buyer’s sole remedy shall be a refund of any amounts paid, and the Auctioneer shall have no further liability. 8. NON-PAYMENT, FRAUD, & CHARGEBACKS 8.1. Non-payment, fraudulent disputes, or chargebacks may result in: Debt collection Legal action Fees up to $250 per incident Account termination 8.2. Buyers authorize the Auction House to provide all necessary documents, logs, IP information, invoices, delivery proofs, and Terms acceptance to banks, processors, or legal agencies in the event of dispute or fraud. 9. RIGHT TO CANCEL BIDS OR ACCOUNTS The Auction House reserves the right to: Cancel bids Remove bidders Reject registrations Terminate accounts at its sole discretion if fraud, abuse, or non-compliance is suspected. 10. GOVERNING LAW & DISPUTE RESOLUTION All disputes shall be resolved in Nevada, under Nevada’s laws. The Buyer agrees to submit to the jurisdiction of the courts located in that state. 11. AGREEMENT By bidding, buying, or registering, the Buyer acknowledges they have read, understood, and agreed to all Terms & Conditions. Subsection A: A-1. Bullion-Specific Rules 1.1. All gold, silver, platinum, and numismatic items are sold AS-IS, with no guarantees of grade, melt value, rarity, or purity beyond what is explicitly stated.?1.2. Weight, purity, and composition details are provided to the best of our knowledge.?1.3. Bullion is a cash-equivalent commodity. Once delivered or picked up, it cannot be returned or refunded for any reason. A-2. All Sales Final – No Chargebacks 2.1. ALL bullion transactions are final.?2.2. No returns, refunds, substitutions, exchanges, or cancellations are permitted.?2.3. Chargebacks are strictly prohibited and treated as fraudulent attempts to reverse a lawful commodity transaction.?2.4. The Auction House may pursue: Collection agency recovery Legal action Administrative charges (up to $250 per incident) Reporting to anti-fraud databases 2. Before bidding online, you must read and accept the Terms and Conditions of Bidding. Read these terms carefully. When you sign your Bidder Registration Agreement or click the 'accept' button online, you enter into a binding legal agreement with ACE Auctioneers. 3. All bids submitted at ACE Auctioneers are final and irrevocable, whether they are submitted in person, online or by proxy. If you are the highest bidder and the auctioneer announces the lot as sold to you, you are the new owner of that item. All sales are final.  4. ACE Auctioneers sells all items ‘as is, where is.’ We make no representations or warranties with respect to the items in our auctions. We recommend that you visit the auction site to inspect any items you'd like to buy before bidding. You may also send someone to the site to conduct the inspection on your behalf. 5. ACE Auctioneers auctions are unreserved unless specified in the lot. Each and every item is sold without reserves, minimums or limits. Ace Auctioneers expressly forbids owners and their agents from bidding on any item they have consigned to an auction. This applies to on-site, online and proxy bidding. 6. Every item becomes the responsibility of the new owner as soon as the auctioneer announces that an item has been sold. If you are the highest bidder, you are responsible for insuring your purchase immediately. 7. Registration to bid is free. ACE Auctioneers reserves the right to refuse issuing of a bidding card for any reason. You may be required to place a refundable bid deposit. 8. Successful bidders are required to pay the buyer’s premium listed in the auction on each lot purchased (one fee per lot).  This administrative fee applies to on-site, online and proxy purchases. There are no additional fees for online and proxy purchases. 9. Buyers cannot take possession of or remove their purchases from the auction site until the total purchase price (including applicable taxes or fees) has been paid in full. If you need us to ship your winning lots, auction house reserves the right to require payment on winning lots before packing up items to be shipped, then expect payment for shipping costs and packing.  ALL ITEMS CAN BE PICKED UP AT YOUR CONVENIENCE, HOWEVER ALL ITEMS MUST BE PAID AND PICKED UP WITHIN THREE BUSINESS DAYS OF THE END OF AUCTION.  ANY ITEMS NOT PAID FOR AND/OR PICKED UP WITHIN SEVEN BUSINESS DAYS OF THE END OF THE ACTION WILL BE DEEMED AS ‘FORFEITED’ AND NO LONGER CONSIDERED SOLD TO THE HIGHEST BIDDER. YOU AGREE THAT ANY PAYMENT OR FEES RECEIVED WILL ALSO BE DEEMED FORFEITED BY YOU AND NOW THE PROPERTY OF THE AUCTION COMPANY AS RECOURSE FOR LOST SALES AND HANDLING COSTS. 10. Please note we take non-payment very seriously. We reserve the right to take any legal action and/or utilize collection services for any unpaid invoices.   11. Auctioneer reserves the right to postpone, cancel or change the date of the auction end time for any reason and at any time without notice.  Auctioneer will alert all bidders of the final auction date via email within a few days leading up to the date of the auction end date.  Buyers are responsible for making payment and collection of their items won at the time of the auction ending, following all terms set forth above. 12. Auctioneer will ship your items anywhere you’d like, with cost of shipping/freight charges and packing materials/labor fees paid by you in advance of shipping.  Once you win lots in our auction, you can elect to get a shipping quote.  Auctioneer reserves the right to require payment on the lots before packing or palletizing, and usually exercises this right in cases where a pallet needs to be built.  You are responsible for all shipping/packing fees to be paid before your items can be shipped.  It is your responsibility to ensure someone is available to accept the packages when they arrive at your location.  Should no one be available and the auctioneer is assessed return shipping fees or additional charges by the carrier, you are responsible for paying those fees, as well as any shipping charges to make a second attempt to ship your goods. Auctioneer is not responsible for any damage that may be incurred through shipping of your item.  You release auctioneer and auction house of all liability for damage to items in shipping.  If there is damage incurred, you are responsible for working with the shipping company with regard to insurance claims etc.  Condition of items sold - The auctioneer and auction company shall not be responsible for the correct description, authenticity, genuineness of, estimated selling price of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrect information in the description, error in cataloguing, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold “as is” and without recourse. Removal - shall be at the expense, liability, and risk of the purchaser. Purchases will be delivered only on presentation of paid bill. Auctioneer shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing or reselling at the expense and risk of the purchaser any article purchased.
