SPECIAL TERMS : The purpose of the catalog is to identify items being sold to the best of the ability of Black Cat Auctions staff. Please review all items carefully before bidding and make your own judgment on identification, authenticity, and condition of items. It is our intention to give accurate descriptions and make note of any damage. It is the bidder's responsibility to determine condition and completeness, etc. of property being offered. We only sell autographs that are pulled from packs or from highly reputable autograph authentication companies like PSA, Beckett, JSA, and Upper Deck. We will not sell in person autographs unless they are authenticated by these companies. You can guarantee that when you buy an autograph from us, it is 100% authentic. There are a lot of fake companies and COA’s out there. Please be careful. Items will be tested to the best of our ability, however it is up to the buyer to verify functionality of all items. No warranty of merchantability or fitness is being offered by the auctioneer, seller, or any other agents. We disclaim any assessment of value by the auctioneer, seller, or any other agents. No allowance, adjustment or rescission of sale will be allowed based upon failure of the property to correspond to the particular need. We offer in person viewing hours and online photos and catalog. If more information or photos are needed we encourage you to ask and we will provide what we can. Items in auction may be property of Black Cat Auctions staff/owners. We like to recycle our goods, so some penny sleeves and toploaders may not be brand new. We do try to avoid the yellowing toploaders. We do our best to list the cards correctly. However, every now and again the year is off the card, there is a spelling error in the name, or a card parallel may not be identified properly. It is your duty as the buyer to due diligence on the card you are placing a bid on. There will be no refunds or money back on cards that have these errors. ALL SALES ARE FINAL NO RETURNS - EVERYTHING IS SOLD AS IS WHERE IS NO WARRANTIES WRITTEN OR IMPLIED. If you have a question, please ask. All risk of loss and responsibility for purchase passes to buyer immediately upon award of bid. REMOVAL: Items must be removed by 5 pm on Sunday unless arranged beforehand, except as otherwise stated in an auction invoice the bidder agrees to remove all property purchased from the auction site and assumes all liability in doing so. Purchases may not be removed from auction site until paid in full and to include any other fees to transfer ownership. We have very limited space. We do not have room to keep items for a period of time. Not being able to remove your items in a timely manner may result in having your bidding privileges revoked. BIDDING : Once a bid is placed it can not be revoked. Placing a bid constitutes express acceptance of all terms and conditions. There is a 20% buyer's premium for online bidding. We DO NOT bid in our own auctions or can see the bidder’s max bid. You can verify this as there are no UCC codes at the top of our terms and conditions. We believe in fair auctions. PAYMENT: Payment must be made via ATG Pay or paid in full in person. We do not accept any other forms of payment. You must have a credit card on file to bid. In online auctions, we will send out an invoice the day after the auction. Bidders will have 2 days to pay before the card on file is charged. In the event of a card not being able to be charged, we will email you. You will then have 2 days to pay before a dispute is filed with Proxibid. If no payment is still made after the dispute settles, you will lose your opportunity to bid in future auctions not only with our company, but other companies on Proxibid as well. We will not take anyone off the Proixibid flagged list if any orders go unpaid. Any orders over $1800 must be via ACH Pay. There is a 20% buyer’s premium for our auctions. The federal and state laws and penalties for failure to settle and pay shall apply. All sales and shipping costs are subject to applicable sales tax unless Black Cat Auctions is provided with proof of exemption PRIOR to bidding. Your invoice will include purchase price/buyer’s premium, shipping, labor fee, and debit/credit card processing fee. You can click on the link and pay via atgPay through Proxibid. If you are picking up your items you can pay by cash. You MUST contact us prior to 8 AM EST the day following the auction to let us know you are picking up. If we do not hear from you, your items will be shipped. SHIPPING : Shipping will be added to the invoice. Shipping usually takes place within 24 - 48 hours of payment. For our card auctions, the breakdown of shipping will occur for STANDARD SIZED cards in toploaders : 1 - 4 cards - $6.50 5 - 9 cards - $7.00 10 - 14 cards - $7.50 15 - 20 cards - $8.00 More than 20 cards will result in a higher rate; however, we use a third party shipping company and are usually still cheaper than taking the cards to USPS or UPS. Slabbed cards and jumbo/thicker/patch cards DO NOT count towards the standard sized card shipping, and can result in a slightly higher price. A tracking number will be sent to you. We will charge insurance for anything over $100. Shipments over $500 will require a signature upon delivery. We will securely and safely package your cards/goods. All items will be shipped USPS or UPS, whichever is cheapest. For our comic auctions, there is no set guide for shipping. Items will be packaged and input into our third party shipping company. Once again, we are usually always cheaper than if we take the items to USPS or UPS. We will ship internationally. Please know that it can be expensive. All items will be shipped in a bubble mailer, large padded bubble mailer, or a box. We DO NOT ship items in envelopes/ESE. All orders being shipped or picked up will have a $2.50 handling fee. This will be shown on your invoice as a Labor Fee. This will be for the entire order, whether you buy 1 item or 100 items. We DO NOT combine shipping from multiple auctions. All items are described to the best of our ability. It is the buyer’s responsibility to determine condition, completeness, and authenticity prior to bidding. We guarantee only autographs obtained directly from manufacturers or authenticated by PSA, Beckett, JSA, or Upper Deck. We do not sell in-person autographs unless authenticated by these companies. Minor catalog errors (e.g., year, spelling, parallel misidentification) do not qualify for refunds. Sleeves, toploaders, or packaging materials may be reused but are inspected for cleanliness and clarity. All property is sold AS IS, WHERE IS, with no warranties expressed or implied, including merchantability or fitness for a particular purpose. There are no refunds, returns, or exchanges. All sales are final, and no chargebacks or payment reversals are permitted. All risk of loss passes to the buyer immediately upon award of bid. Governing Law: All transactions are governed by the laws of the State of Indiana. Venue for any dispute shall be in Kosciusko County, Indiana. Limitation of Liability: Black Cat Auctions’ total liability shall not exceed the amount actually paid for the item in dispute. Severability: If any portion of these Terms & Conditions is found invalid, the remaining provisions remain in full effect. By bidding, you acknowledge and agree to all terms above.
