Participation Requirements: All onsite bidders are required to provide a valid driver’s license at time of registration. All online bidders are required to provide a valid credit/debit card at time of registration.
Sale Announcements: Announcements the day of the sale take precedence over all printed material and advertising.
Personal and Property Risk: Persons attending during exhibition, sale, and/or removal of goods assume all risks of damage of or loss to person and property and specifically release the seller and Southeastern Auction Company, Inc. from liability thereof. SEAC is not responsible for accidents on auction premises. Bidder agrees the auction site is potentially dangerous because of heavy equipment operation. Regardless of cause, SEAC or its agents will not be responsible for any injury to anyone at the auction site. SEAC shall not be responsible for any loss or damage to any lot.
Inspection: Most assets offered for sale are used and may contain defects not immediately detectable. SEAC encourages bidders to inspect the property prior to bidding. Bidders must adhere to the inspection dates and times indicated in the asset description. All units are sold AS IS, WHERE IS, with all faults, including without limitation any and all defects, imperfections and inconsistencies. No guarantee of ANY kind applies, regardless of statement of condition made from the auction block. All information we provide for auction items such as serial numbers, weights, horsepower, mileage, lift capacities, etc., is taken from sources deemed to be accurate. We do not guarantee that information but provide it for your assistance. Buyer shall rely entirely on their own inspection and information. Bidder agrees that everything is sold as is and no item they purchase can be returned for any reason. All sales FINAL. No exceptions.
Consideration of Bid: Southeastern Auction Company, Inc. reserves the right to accept or reject any and all bids and to withdraw from sale any of the items listed. Bidder is responsible for knowing which item he is bidding on. Bidders are to be held personally liable for any bids made with their Bidding Number. If he is unsure, he should inquire or not bid. Winning bidder then enters an enforceable contract and will be expected to pay for the items in which you were evidenced to be the successful bidder. Southeastern Auction Company, Inc. will not honor “mistakes.” Once an item has been declared sold, bidder cannot retract bid and is required to carry through with the purchase. The auctioneer reserves the right to accept bids in any increment he feels is the best interest of his client, the seller. The auctioneer reserves the right to reject the bidding of any person whose conduct, actions, or adverse comments he feels are not in the best interest of the seller.
Buyer’s Premium: 10% Buyer’s Premium added to final bid price of all items plus an additional 2% online premium.
Sales Tax: Buyers may be subject to payment of State and/or local sales and/or use tax, unless a valid tax exemption form is on file at the time of purchase. Buyers are responsible for contacting the appropriate tax office, completing any forms, and paying any taxes that may be imposed.
Payment: Payment in full is due by end of sale day for ALL onsite bidders regardless of loadout. All items purchased online must be paid in full by WIRE TRANSFER unless prior arrangements have been made with SEAC. Please check spam or junk mail for invoice if not received with 24 hours after sale completion. Cash payments exceeding $10,000 require completion of Form 8300. ANY PAYMENT NOT RECEIVED WITHIN 72 HOURS WILL BE CHARGED A $100 LATE FEE. Proxibid bidders may utilize the payment processer, atgPay. Cards will be automatically charged full invoice amount if invoice is not paid within 72 hours. atgPay will incur an additional 3.75% + .25 cents. No exceptions. Please make sure, before bidding, you are able to do this or have made previous arrangements with SEAC. Total Purchase amount is Bid price plus Buyers premium and applicable state and local taxes. Declined cards will be charged a $10.00 re-processing fee for each attempt to bill your card. PLEASE BE SURE YOU HAVE SUFFICIENT CREDIT ON YOUR CARD PRIOR TO PURCHASING! Items paid for by check with a bank letter can be picked up upon payment. Items paid for without a bank letter can be picked up once check clears (2-3 business days). Payment Options: Visa, MasterCard, Discover, American Express, Check, Money Order, Wire Transfer, and Cash. ABSOLUTELY NO INTERNATIONAL CREDIT CARD PAYMENTS WILL BE ACCEPTED.
Removal: NO LOAD OUT ON SATURDAY or SUNDAY. SEAC staff will be onsite Monday – Wednesday 9:00AM – 5:00PM following auction. After Wednesday, you must call our office to schedule an appointment. All purchases must be removed from auction site/unit location within ten (10) business days or storage fees will begin accruing at a minimum of $100 per week. After 30 business days, all items not removed from auction location will be forfeited by buyer and SEAC reserves the right to reclaim and resale. Successful bidders are responsible for loading and removal of any and all property awarded to them from the auction site/unit location. The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. Under no circumstances will Southeastern Auction Company, Inc. assume responsibility for packing, loading or shipping. Furthermore, SEAC or its employees assume no responsibility for loading or unloading equipment but will provide assistance. We are not responsible for securing loads or any damage while loading or unloading.
Unloading/Loading: Southeastern Auction Company, Inc. shall not be responsible for any loss or damage to any lot. Every effort is made to “guard” merchandise throughout the auction: however, the bidder becomes solely responsible for all items purchased by him immediately following his winning bid. Therefore, he is advised to further guard his items at his own discretion. Bidder assumes all risk of loss or damage immediately upon declaration of ‘SOLD’ by the auctioneer.
Shipping: Shipping arrangements and cost thereof are BUYERS SOLE RESPONSIBILITY. All buyers are responsible for their own loading and rigging. Any packaging such as palletizing, wrapping, containerizing that is required by shipper is the responsibility of the buyer. SEAC can assist with handling but will result in additional charges to the buyer.
Vehicle Titles: Southeastern Auction Company, Inc. will issue a title or certificate upon receipt of payment and completion of necessary paperwork/online title form. A $99 processing fee (regardless of home state) will be charged to the buyer for all titled items purchased. TAVT will be charged to Georgia residents and title will come to you directly from state. No exceptions. PLEASE PROMPTY COMPLETE NECESSARY ONLINE TITLE FORM (i.e., valid drivers license, etc.). Titles will be mailed to out of state purchasers within 30 business days. Southeastern Auction Company, Inc. is NOT responsible if title is lost, damaged, or stolen. Replacement title fee is $100.
Internet Bids: SEAC will not be responsible for bids missed due to internet failure or any other technical difficulties. PLEASE DO NOT BID ON MOBILE DEVICE.
Online Purchases: No items can be invoiced or picked up until end of sale day for purchases made through online platforms such as Proxibid or Equipment Facts.
Default: Default shall include (1) failure to observe these terms and conditions; (2) failure to make good and timely payment; or (3) failure to remove all items within the specified time. Default may result in termination of the contract and suspension from participation in all future sales until the default has been cured. If the Buyer fails in the performance of their obligations, SEAC may exercise such rights and may pursue such remedies as are provided by law. SEAC reserves the right to reclaim and resell all items not removed by Buyer thirty (30) days from the expiration of specified removal date.
Security Interest: Seller and/or SEAC has a security interest in the assets until final valid payment has been received. In the event of a dispute or charge back Seller and/or SEAC maintain the security interest and Buyer agrees that all assets will be returned within 24 hours of such action and further agree to compensate Seller and/or SEAC for any depreciation in the assets and any costs associated with recovery including any attorney fees and resale fees they incur.
CHANGES IN CIRCUMSTANCE: All aspects of this auction are subject to change without notice. The Auctioneer reserves the right to – at any time and in the Auctioneer’s sole and absolute discretion – (a) add or remove items from the auction, (b) split or combine lots, (c) add minimum bids or reserve prices, (d) cancel, suspend, extend, or reschedule the sale of an individual item, lot, auction, and/or auction event, (e) make changes to the auction’s closing, inspection, or removal times, (f) reopen the bidding in its sole and absolute discretion, or (g) take any other action the Auctioneer deems necessary to effect the fair conduct of this sale or protection of buyers’, sellers’, or other parties’ interests. In the event a seller withdraws an item from this auction prior to the close of the auction, the Auctioneer may leave the item on the catalog and buy the item back on behalf of the seller to establish the Auctioneer’s earned commission and the buyer’s premium due to the Auctioneer from the seller.
Acceptance of Terms and Conditions. The Buyer acknowledges by his or her participation in this auction, that he/she and the auction company hereby irrevocably and unconditionally submit to the exclusive jurisdiction of the state and local courts of Union County, Georgia, United States of America for the purpose of any suit, action or other proceeding arising out of or based upon this Auction, and further agree not to commence any suit, action or other proceeding arising out of or based upon this Auction except in state and local courts of Union County, Georgia, United States of America. By submitting a bid, the bidder agrees that they have read, fully understand and accept these Terms and Conditions, both onsite and online, and agree to pay for and remove the property, if the bid is accepted, by the dates and times specified.
