Bidders who bid remotely and are not present at the live auction or who do not preview equipment beforehand understand and acknowledge that they may not be able to inspect items as thoroughly as if examined in person. It is the bidder’s responsibility to determine the condition, age, genuineness, value, or any other determinative factor. All items are sold as-is, and purchases may not be returned for any reason. TERMS & CONDITIONS: All purchases must be settled on Sale Day. Full payment must be made via Cash, Cashier’s Check, or Company/Personal Check accompanied by a Bank Letter of Credit specifying the amount of purchases guaranteed by the bank. Positively no exceptions. All checks must be made payable to GovAuction. SALES TAX: All sales will be subject to applicable State and Local Sales Tax laws. BIDDING: In the event of a tie bid, the auctioneer reserves the right to reopen bidding between the tied parties. The auctioneer also reserves the right to revoke any bid card at any time. Anyone bidding on behalf of another account must obtain a separate bid number for that account. NO WARRANTIES: All items are sold AS-IS, WHERE-IS, with all faults. Bidders have had the opportunity to inspect sale items and agree to rely solely on their own inspection. All sales are final. No bidder shall be entitled to any adjustment, allowance, damages, or any remedy based on the condition of any purchased item. AUCTION SITE SAFETY: All bidders attend the auction site at their own risk. Bidders acknowledge the inherent dangers of an auction environment due to heavy equipment operation. GovAuction and its agents are not liable for any injury occurring on site, regardless of cause. RISK OF LOSS: Once the auctioneer accepts the highest bid, the item is considered sold. At that point, the buyer assumes delivery and all associated risk of loss. Buyers are responsible for obtaining appropriate liability insurance as required by law. TITLES: A $95 processing fee will be charged to the buyer for all titled items. Auto dealers must provide a copy of their dealer’s license. Titles will not be available on sale day and will be mailed approximately 10 business days after satisfactory settlement. No item will be sold unless GovAuction has possession of the title prior to the auction. Items marked “No Title” will not have titles available. LOADING: GovAuction and its employees are not responsible for loading or unloading equipment but will assist as able. Buyers are solely responsible for securing their loads.
