All sales are final. Items are sold AS-IS, with no warranty expressed or implied. It is the bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Kaufman Realty & Auctions may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Kaufman Realty & Auctions be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpse. Bidder shall be the sole judge of value.
By registering to bid or placing a bid Bidder agrees to be bound by all of these terms and conditions and any other annouced terms and conditions of sale or rules of the site. All internet bidders agree that bids placed on the Internet shall ahve the same legal effect as if they were in attendance at the auction in person.
Bidders who bidd from off-site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, value or any other determinative factor. Kaufman Realty & Auctions shall endeavor to describe in detail each item and any pertinent information about it.
Kaufman Realty & Auctions is providing Internet pre-auction and live bidding as a service to bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall bidder have any kind of claim against Kaufman Realty & Auction or anyone else if the Internet service fails to work correctly before or during the live auction. Kaufman Realty & Auctions will not be responsible for any missed bids from the source. Internet bidders who desire to make certian their bid is acknowledge should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Kaufman Realty & Auctions reserves the right to withdraw or re-catalog items in this auction.
Kaufman Realty & Auctions reserves the right to accept or reject any and all bids. Kaufman Realty & Auctions may refuse a buyer's number to anyone for any reason. Bidder agrees to comply with any stated additional terms or conditions associated with any particular item.

Terms & Conditions
At the close of the auction, successful bidders will be emailed a contract to be executed and returned to Kaufman Realty & Auctions. Successful bidders will deposit 10% of the contract price which includes the 4% buyer’s premium in the form of cashier’s check or wire transfer with Kaufman Realty & Auctions within 24 hours of the closing of the auction. The entirety of the remaining balance is due at closing. Instructions for wire transfer and /or cashier’s check transmittal will be sent by e-mail to the successful bidder. Purchaser shall be responsible for all wire transfer fees.
Contract Documents: Contract documents will be sent by e-mail to the successful bidder, who must execute and fax or email back to Kaufman Realty & Auctions within 48 hours of the end of the auction. Successful bidders not executing and returning their contract with earnest money deposit within 48 hours of the conclusion of the auction will be considered in default.
Bidder Verification: The identity of all bidders will be verified; bidding rights are provisional, and if complete verification is not possible, Kaufman will reject the registration, and bidding activity will be terminated.
Buyer’s Premium: A 5% buyer’s premium will be added to the bid price to determine the final contract price.
Buyer’s Premium Example:
Bid Price: $100,000
Plus 5% Buyer’s Premium: $5,000
Total Contract Price: $105,000
Closings: Time being of the essence, these sales shall be closed on or before Monday September 28, 2009. The seller will pay for preparation of the deed of conveyance, and pay closing costs as per auction purchase agreement; a sample of this agreement can be obtained, attached to this auction.

All parcels are subject to final county approval. Property sells subject to all articles of record including but not limited to leases and easements.
