Terms Of Sale
AS A USER OF IRONXCHANGE AUCTIONS, YOU ACCEPT THE TERMS AND CONDITIONS OF EACH AUCTION AND OF THIS SITE. YOU UNDERSTAND AND AGREE YOU ARE ENTERING INTO A LEGAL AND BINDING CONTRACT. ALL BIDDERS ACKNOWLEDGE THAT THEY HAVE READ AND COMPREHEND IRONXCHANGE'S TERMS AND CONDITIONS AND THEY ACCEPT THEM.
REGISTER
All bidders registering to bid with IronXchange have filled out the login information and understand the terms and conditions. When logging in, you are accepting that you are who you say you are and agree with the conditions. If you choose to login as someone other than yourself, you understand fraudulent activity within the site will be subject to legal action and may result in criminal charges. If you plan on bidding for items over $20,000, we will need you to fill out our bank approval form or call us with your bank information and we will contact them for you.
‘AS IS, WHERE IS’
The inventory on each auction has been appraised and inspected by one of our employees at IronXchange. IronXchange needs you to understand the equipment is sold “AS IS, WHERE IS”, this means we do not guarantee or sell with warranty. It is the bidders due diligence, to contact the representative listed in the description and the representative will assist you with further details and arrange a showing of the equipment. The bidder will not receive a refund or a rebate for any reason.
IRONXCHANGE PROCESS
IronXchange and it’s employees have discussed every piece of inventory with the owner to assess value . We go to the location of the equipment and give our professional opinion on what the item is worth and the quality of the item. The seller decides to list the item with IronXchange. He/she can leave the item on his/her site or at our location. IronXchange takes pictures (maybe videos) of the item. IronXchange Representatives are not professional photographers. We are representing the item(s) with the best of our knowledge. The photos may or may not show all the good or the bad aspects of the item(s). To get the best inspection of the item(s), you need to do it on your own. Until the auction, the items are listed with a 'Buy It Now' price or 'Make An Offer'.
BUY IT NOW
IronXchange has a 'Buy It Now' option on all inventory listed. When equipment is consigned with us, there will be a purchase price on each piece of equipment. The 'Buy It Now' price includes the buyer's premium in the price. If applicable, taxes will be added to the total purchase price. When you confirm the 'Buy It Now' price, you are understanding you are purchasing the item for the amount listed and all purchases are final and will not be refunded or retracted for any reason. Always remember to keep your username and password in a secure place and not to share it with anyone because all sales are final.
MAKE AN OFFER
IronXchange has a 'Make An Offer' option on all inventory listed. As a buyer, if you choose to, you can make an offer on any item listed with IronXchange. When you click 'Make An Offer', a box will pop up on your screen and it will ask you to list a price you would like to offer. IronXchange will receive an email with the price offered. We have the option to ACCEPT, DECLINE, or COUNTER the offer. You will receive a confirmation of some sort stating what we decided to do.
PAYMENT
When using IronXchange’s online services and you are the final winning bid, you are making firm commitments to purchase the item(s) and you have entered a legal and binding contract. Once an auction is closed, bids may not be retracted or cancelled for any reason. Fraudulent bidding or non paying bidders could be subject to legal action and may result in criminal charges. Each auction is may have different online fees. Please review the terms and conditions of each auction before bidding. Within 3 business days or less of receipt of invoice, you agree to pay the full amount for online purchases in U.S. funds. State sales tax, transfer, license fees, and document fees will be included on the invoice where applicable. NO ITEMS WILL BE RELEASED UNTIL PAYMENTS ARE CLEARED THROUGH OUR SECURE ACCOUNT. REMOVAL OF INVENTORY
When you are the winning bidder, you will receive an email or phone call from IronXchange. Then, the process of payment will begin. After all the proper steps are taken, both the buyer and the seller will be emailed or called one final time saying the item(s) are ready for pick-up. The buyer will receive the 'Bill of Lading' from IronXchange. Whomever picks up the equipment from the seller, whether it is the buyer personally or a shipping company, the person will need to show the 'Bill of Lading' to the seller to confirm the purchase. It is the buyer's responsibility to arrange with the seller, pick-up and delivery of the item(s). IronXchange doesn’t make arrangements for item(s) to be picked-up or delivered. The buyer will receive the seller’s contact information and will need to make the arrangements on his/her own. Once the funds have been transferred, the buyer and seller will be notified and the buyer will have 10 business days to pick up the item(s). If the item(s) is not picked up after the 10 days of funds transferred, the buyer will be charged $25/day for storage. If the buyer chooses not to pick up the equipment within 30 days of notification and no other arrangements have been made, the buyer will receive a bill for the fees acquired, the seller will receive payment for the equipment, and the item will then become property of IronXchange.
BILL OF LADING
As the buyer, you have purchased an item through IronXchange. Once the funds are cleared in our secure account, the buyer will receive the 'Bill of Lading' from IronXchange. Whoever picks up the equipment from the seller, whether it is the buyer personally or a shipping company, the shipper will need to show the 'Bill of Lading' to the seller to confirm the purchase. The shipper needs to get the signature of the seller and get the form back to IronXchange.
BIDDING
When registering, you are entering a legal and binding contract with IronXchange and admitting you are who you say you are. You will never login on behalf of another person. You agree to not bid on your own items or on behalf of another seller. If found guilty, you could be subject to legal recourse and possible criminal charges.
BUYER’S PREMIUM
IronXchange charges up to a 5% buyer’s premium to the purchase price if you win the bid. The buyer’s premium will be added to the final invoice you receive. All applicable taxes will be applied to your final invoice.
TITLES/UCC FILING
On titled items, there will be a $30 title processing fee. IronXchange will contact the buyer through email or phone the day of auction about title information. To receive the title, we require name(s) and complete address through email or in writing for our records. Once funds are cleared and completed, titles will be mailed no sooner than 17 business days (unless description of item says otherwise). IronXchange is not responsible for lost titles. There will be a $50 UCC Filing charge on every item with a UCC Filing charged to the seller. IronXchange will contact the state to make sure all the UCC Filings are taken care of and the item being purchased is free and clear. It is the sellers responsibility to be upfront and honest with all the information regarding an item with UCC Filings. Once the item is cleared from the state and all the UCC Filings are taken care of, the buyer will receive an email or phone call relaying the information and will be given the correct information to pick up the item purchased.
