Fraudulent Bidders/Unpaid Invoices: Air Works Consignment Auction LTD reserves the right, and you acknowledge and agree to its exercise of its right, to notify third parties, including law enforcement authorities, credits bureaus, other auction companies and industry regulators and authorities, about Bidders involved with or connected to fraudulent bidding or failure to pay invoices in accordance with these Auction specific terms fully. Liability for Bids: Any bidder, participating on behalf of their employer or acting as agent on behalf of a principal and/or principals, whether bidding, buying, attending, or otherwise, agree that such actions shall constitute sufficient evidence that such Bidder is authorized to bind such employer and/or principal. Air Works Auction reserves the right to hold any and all individuals bidding personally liable for full payment of all winning bids and any and all obligations incurred in relation to said winning bid, whether incurred on behalf of their employer or principal or not. Please Note; we are required to collect local sales tax on most auctions. If you Have a tax ID number and are tax-exempt, we ask that you put it on file with Proxibid. If you have a valid reason to be tax-exempt and don’t have a tax ID Number, You can fill out and exemption form and send it to us and we will remove or refund the tax. Any titled vehicles will have the sales tax removed from the invoice and you will remit the tax when you register the vehicle. If your payment is processed through AtgPay, they collect and remit sales tax. We have no control over this, and you must have a sales tax form on file with them. Air Works Consignment Auction will not give refunds on sales tax, they must be processed from AtgPay specifically. All items are sold 'As Is Where Is' The Air Works Consignment Auction Ltd. acts only as an agent of the seller and assumes no responsibility for seller statements. All items sell as is where is with no warranties or guarantees. Buyers are encouraged to inspect items and equipment before bidding on them as the winning bidder is committing to a legally binding purchase. We have good, trusted sellers and ask the sellers to represent their items in an ethical manner but ask that you the buyer understand you are purchasing items and equipment upon your own final inspection and discretion. All items are to be removed from the premises by the purchaser. In all disputed bids, the decision of the auctioneer on the stand is final. The sales price is the price recorded by the clerk on the clerking sheet at the time of the sale. If you question this price, we will endeavor to check with the clerk and the auctioneer. However, if they don't recall the item or a difference in price, the price on the clerking sheet shall stand and you are expected to pay for the item. Purchaser assumes responsibility for items at the time of purchase (i.e., when the auctioneer declares the item sold). Do not leave items unattended. When an item is sold, the buyer is responsible for it, including damage and theft. All items sell as is where is with no warranties or guarantees.
