Bidder shall be the sole judge of value. Buyer should be aware that this is an onsite Auction and many people may handle the coins at the preview and auction. Every effort will be made to ensure that each coin stays in the same condition that it was brought to us and photographed in. However all property is sold 'AS IS', and ALL SALES ARE FINAL. 2. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Allen & Marshall Auctioneers and Appraisers, LLC will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold 'as is' and that they may not return any item they purchase. We have made every attempt to provide high quality photographs of the items. If any major damage was observed it will be noted. 3. Allen & Marshall Auctioneers and Appraisers, LLC is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Allen & Marshall Auctioneers and Appraisers, LLC or anyone else if the Internet service fails to work correctly before or during the live auction. Allen & Marshall Auctioneers and Appraisers, LLC will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Allen & Marshall Auctioneers and Appraisers, LLC reserves the right to withdraw or re-catalog items in this auction. 4. The Bidder is responsible for knowing which item is being bid on. If the Bidder is unsure, they should inquire or not bid. When becoming the winning bidder at auction you have effected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor 'mistakes'. 5. The Auctioneer reserves the right to accept bids in any increment he feels is in the best interest of his client, the Seller. The Auctioneer reserves the right to reject the bidding of any person whose conduct, actions, or adverse comments he feels are not in the best interest of the Seller. 6. Titles will be disbursed on auction day only if payment is made in cash; otherwise they will be mailed when funds clear our bank. 7. Purchaser does hereby indemnify and hold harmless Auctioneer and Seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal of items purchased. Purchaser assumes all risk and liability whatsoever resulting from the use of the item(s) sold hereunder; and shall defend, indemnify, and save harmless Auctioneer and Seller from any liability. 8. If the foregoing conditions or any other applicable conditions are not complied with, in addition to other remedies available to Auctioneer and Seller by law, including without limitation, the right to hold the purchaser liable for the bid price, the Auctioneer, at their option may (1) resell the property publicly or privately, with purchaser being liable for the payment of any deficiency plus all costs incurred, or (2) cancel the sale, retaining liquidated damages on all payments made by purchaser, Auctioneer commission and all other incidental damages will be charged. 9. Information in brochures, catalogs and other advertisements are from sources believed to be reliable; however prospective purchasers are urged to inspect the inventory or property to satisfy themselves as to condition, model, manufacturer, year, features, mileage, survey, acres, etc. Neither the Auctioneer or our client make any guarantees and are not responsible for listing or advertising inaccuracies or discrepancies. 10. Shipping Instructions: Allen and Marshall Auctioneers and Appraisers, LLC does not offer shipping. However, shipping is available through the local UPS Pack and Ship Store of Salisbury, MD. We will arrange delivery to the UPS Pack & Ship shore on or about Wed. 12/14 for those whose payments have been processed & received. Please contact Milt at 410-749-5070 if you have any questions. Allen and Marshall Auctioneers and Appraisers, LLC has no affiliation with the Pack and Ship store and has no control over pick-up fees or shipping freight fees through the UPS Store. Allen & Marshall Auctioneers and Appraisers is not a shipping company. If you want do not want to use the UPS Pack & Ship Store please contact the shipper of your choice and have them pick the items up for you at our Auction Facility. Pick Up Dates: Items should be picked up at the Auction Site on Saturday July 6th between the hours of 9 AM & 5 PM. We will also have limited staff available onsite for pickup on Sunday July 7th from 9 AM - 12 Noon. Time is of the essence removing the items from the property. The Real Estate is scheduled to go to settlement on Monday July 8th, 2019. Buyer is responsible for removing all items in a timely manner. Buyer is responsible for bringing any required manpower, tools, boxes, blankets, wheel cart or dollies needed to remove your items from the property. We will have staff onsite to assist in finding your items but they will not be available for loading your items. If you can't pick your items up during the time scheduled, you are responsible for designating someone to pick your items up for you during the scheduled time. Shipping/Return of items to Our Facility: If you are unable to pick your items up at the Auction Site the items could be returned to our Auction Facility or be delivered to a Shipper. A&M Auctioneers does not ship items. However, shipping is available through either a UPS or Fedex local pack and ship store that are both located in Salisbury MD near our Auction Facility. This will require that we load and transport your items back to our Auction Facility which is Approx. 100 Miles from the Auction Site. There will be a charge to cover out time and expenses to do this. It should be understood that this type of shipping can be very expensive. A&M Auctions has no affiliation with either Shipping Company and has no control over the Shipping/Handling costs required to ship the items to you. Items that returned need to have pickup/shipping arrangements made within 10 days of the Auction. Items not picked up or shipping arrangements made will be considered abandoned and will be disposed of at the discretion of the Auction Company. As an Alternative there are Several UPS & Fedex Pack & Ship locations located in Virginia Beach, VA area. It would be approx. a 80 mile round trip for them to come to the Auction site and pick your items up and then return the items to their respective stores. 11. All statements made by the Auctioneer the day of the auction take precedence over oral statements and/or printed materials. 12. Maryland Sales Tax (6%) will be charged to MD Buyers unless you have a Maryland Tax ID. Items being shipped out of Maryland will not be charged tax. 13. Items not picked up or shipping arrangements made within 30 Days will be resold at the rick and expense of the purchaser. 14. The Auction Co. reserves the right to extend the bidding time if an error should occur with the online server. 15. Auctioneers reserves the right to Add/Remove items, modify descriptions or cancel the auction at any time. 16.
