Your Credit Card ON FILE WITH PROXIBID will be charged AFTER THAT PERIOD FOR Total Purchase Amount +3% CREDIT CARD FEE unless you contact us prior to arrange to wire funds. Total Purchase amount is Bid price plus Buyers premium and applicable state and local taxes. Declined cards will be charged a $10.00 re-processing fee for each attempt to bill your card. 2) There is an additional 2% Internet Purchase fee on top of the following: American Auctioneers charges 10% Buyer's Premium on all items plus any applicable sales tax and credit card fees. Credit card payments will be charged an additional 3% buyer premium.
3) Applicable State, County & City Sales Tax will be charged on all Lots unless you are exempt from Sales Tax and you provide tax resale certificate and exception certificates that are acceptable to the State of FLORIDA. ALL TITLED TRUCKS/TRAILERS WILL BE CHARGED $99 TITLE FEE REGARDLESS OF PURCHASER RESIDENT STATE.
4) Auctioneer must be paid in full within 72 hours of auction by bank wire.
5) NO SUNDAY LOAD OUT! All purchases must be removed from the premises by FRIDAY FOLLOWING THE AUCTION.
6) Bidders are to be held personally liable for any bids made with their Bidding Number.
7) The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute the Auctioneers shall have absolute discretion either to settle such dispute or to re-offer the lot for re-sale.
8) The Auctioneer accepts no liability for loss or damage howsoever arising from any Lots not presented for sale.
10) The Auctioneer has described the Lot(s) in the catalog to the best of their ability and belief from information furnished by the Vendor(s) who shall be alone responsible for any error or miss-statement, which there may be. The Auctioneer undertakes no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact Failure to be informed will not constitute reversal of bid. Once an item is sold, the buyer is responsible for payment - no exceptions.
11) Each and every Lot is sold 'as is, where is'. The Auctioneer provides no guarantees or warranties (express or implied) in respect of the Equipment contained in the Lot. All representations made by the Auctioneer, its servants or agents are to be considered lay opinions only and the Auctioneer and Auction Company accept no liability for any purchase made by a Buyer in reliance upon them.
12) The Buyer agrees to insure the Equipment purchased against all losses from the Auction Date until removal of the Equipment by the Buyer.
13.) The Buyer acknowledges by his or her participation in this auction, that he/she and the auction company hereby irrevocably and unconditionally submit to the exclusive jurisdiction of the state and local courts of MARION County, FLORIDA, United States of America for the purpose of any suit, action or other proceeding arising out of or based upon this Auction, and further agree not to commence any suit, action or other proceeding arising out of or based upon this Auction except in state and local courts of MARION County, FLORIDA, United States of America.
14) The Buyer acknowledges by his or her participation in the auction that he/she has read and agrees to be bound by the additional terms and conditions set forth.
