VESSELS ESTATE AUCTION TERMS & CONDITIONS 1. All items are being sold “AS IS, WHERE IS” without warranties or representations of merchantability, condition, fitness, nor of any other kind, express or implied. All items are available for examination and due diligence prior to bidding. Written and oral descriptions and statements are based on research via internet and/or industry review and opinions and should in no way be interpreted as a guarantee of any kind as to authenticity, age, condition, materials or any other feature of any item being sold. B A RIGBY Auctions has attempted to catalog and describe every item accurately and will attempt to disclose any defect but will not be responsible or liable for the accuracy or correctness of the catalog or descriptions of any lot being sold. No exceptions. It is recommended that all prospective bidders examine any lot in which they have an interest and to perform their own due diligence. By placing a bid, either in person, via the internet, by phone or by absentee bid, bidder acknowledges that they have examined the item on which they are bidding to their satisfaction, and they are accepting the item(s) AS IS or that they have chosen NOT to examine the items and that they are therefore forfeiting their right to inspection and are accepting the item in AS IS present condition. If you require absolute certainty regarding authenticity and details of any item and your requests for verification leave uncertainties, we recommend that you have an expert examine the item for you prior to bidding or that you do not bid on the item in question. Please make note the B A RIGBY Auctions does not offer purchase refunds as every item is being sold AS IS, in PRESENT CONDITION and all sales are final. No exceptions. 2. PAYMENT: Terms of the auction are: Cash, Personal or Company Checks with proper ID, Cashier’s Checks, Visa, MasterCard, AMEX, or bank wire transfer. No financing will be provided on any item therefore each item must be paid for IN FULL the day of auction. For all buyers paying by check, including Cashier’s Checks, B A RIGBY Auctions reserves the right to hold all purchases until the buyer’s check(s)have been verified and/or have cleared the bank. A 10% buyers premium will apply on every item for buyers attending the live on site auction. A 15% buyers premium will apply to each item of personal property purchased online. The buyers premium will be added to the highest winning bid to determine the purchase price. All buyers must be properly registered prior to bidding and to receive a bidder’s number. No exceptions. 3. The highest bidder will be the winning bidder on each item as acknowledged by the auctioneer. In the event of a dispute between bidders, the auctioneer will have the final discretion to determine the winning bidder or to immediately resell the item in dispute. Should any dispute arise after the auction, B A RIGBY Auctions’ records will be final and please note that all transactions are recorded. 4. SHIPPING: B A RIGBY Auctions will provide the buyer(s) with our local recommended company for packing and shipping and they will be in attendance at the auction. NOTE: B A RIGBY Auctions will NOT engage in the packing or shipping of any item. Therefore, it will be the buyer’s responsibility to make and confirm their own packing and shipping arrangements and to arrange for the required payment. If your item(s) are damaged during shipment, it is the buyer’s responsibility to contact the shipper to file the appropriate claim. All items must be removed from the premises within 24 hours of the conclusion of the auction. Unless prior arrangements have been made and accepted by B A RIGBY Auctions, items not removed by the specified deadline for removal will be charged a storage and handling fee of $10.00 per day per item until removed. 5. If B A RIGBY Auctions is prevented, for whatever reason, from making any item available for pickup and/or shipping, our liability shall be limited to the sum actually paid by the purchaser for said item. 6. B A RIGBY Auctions reserves the right to withdraw any item prior to the auction without liability or recourse of any nature. 7. The auctioneer reserves the right to reject any bid not proportionate to the value of any item offered. 8. If any applicable conditions herein are not met by the purchaser, B A RIGBY Auctions may either cancel the sale, retaining all payments made by the purchaser as liquidated damages or resell the items at public auction without reserve whereas the purchaser in default will be liable for any deficiency and costs including handling charges and any and all related expenses of both auctions. 9. In the unlikely event that we lose Internet connection with the online auction provider, B A RIGBY Auctions reserves the right, in its sole discretion, to cancel the remainder of the online auction and proceed with live on site bidding only. 10. These terms and conditions of auction as well as the respective rights of B A RIGBY Auctions, their staff and associates and all purchasers shall be governed by the laws of the State of Texas.
