Real Estate: 10% down payment day of auction. Balance by November 30, 2011. Buyer pays all realty transfer taxes. Personal Property: Payment in full at time of auction. All sales final in "as is" condition. 1. All items are sold in “AS IS” condition and “WHERE IS” with no warranties or guarantees of any type from Seller or Barr/Davis Auctioneers, LLC. Prospective purchasers shall rely solely on their own inspection of the item or shall agree to waive inspection if not seen. 2. Any shipping required shall be purchasers sold responsibility and expense. Seller and Barr/Davis Auctioneers, LLC will not arrange or pay for any shipping of items purchased at auction. 3. Prospective purchasers may be permitted to store purchased items at the current location for maximum of 5 days from the day of auction at purchasers liability. If purchaser does not remove an item the day of auction, Seller and Barr/Davis Auctioneers, LLC shall have no liability of any type for items purchased and not removed day of auction. 4. All purchases, including buyer premium, must be paid in full day of auction regardless of when items are removed. 5. Purchasers unable to pay at the auction site shall be required to wire transfer funds to Barr/Davis Auctioneers, LLC escrow account by 12:00 Noon Eastern Time on October 12, 2011. Should buyer fail to comply, the Seller and Barr/Davis Auctioneers, LLC shall be permitted to cancel the sale and sell the item to another bidder. 6. Vehicle titles will be transferred to buyer upon complete payment at buyers expense. Sales Tax may be applicable at time of transfer. Seller will provide a clear marketable title. 7. If vehicles purchased by a Pennsylvania resident and are to be registered in Pennsylvania, Buyer shall be responsible for any sales tax or transfer expense incurred. 8. Removal of any items after the completion of the auction shall be made by appointment only with Barr/Davis Auctioneers, LLC.
