If you choose to make this certification, the Terms and Conditions will become binding both on you and on the Auctioneer, and all parties will be expected to abide by the Terms and Conditions if any issues arise in connection with this sale. Please read these Terms and Conditions carefully! They contain important information about the online auction itself and your rights and responsibilities as a bidder. 1. This is a public online auction, conducted by Scofield Auctions, Inc. (the Auctioneer). The principal auctioneer is Stephen H. Schofield, NH #2272. 2. Payment Instructions: We accept Visa, MasterCard, Discover Card, and wire transfer only. A 20% online buyer's premium will be added to all sales conducted. 3. There will be no sales tax charged for online sales. 4. Scofield Auction, Inc. has put forth every effort in preparing the catalog for this auction to provide accurate descriptions of all items. All property is sold "as-is" and it is the bidder's responsibility to determine the exact condition of each item. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. Absolutely NO refunds will be offered. 5. This auction is being conducted under appropriate State and Local laws and the Uniform Commercial Code. Any additional terms or conditions of sale shall be announced prior to the auction. Bidding on any item indicates acceptance of these terms and conditions. 6. Registration: When you go to the auction catalog, simply click on the "Register" button at the top of the page. It may take a few minutes to register, so allow yourself some time before the auction begins to complete the process. You will need to place a credit card on file for verification and in case you choose to use the card to pay for your purchases. Proxibid does not charge a fee to register. You only need to register once with Proxibid to be able to bid in all future auctions. 7. In order to better serve our customers, all bidders must provide their name, address, daytime phone number, and email address at which they can be contacted. This is to insure good communication between Scofield Auction, Inc. and the bidder throughout any transactions. 8. Bidder's Duty to Update Information: Whether you are a new or returning bidder, you agree that if any of the information associated with your bidder number - including contact information- changes at any time prior to, during, or after this sale, you will notify the Auctioneer of the change by updating your bidder profile. 9. Conduct of Sale: All deposits, bids, and credits in this sale will be made in United States Dollars. You agree not to use any hardware, software, program, or system that would interfere with the orderly conduct of this sale. You further agree not to copy, reproduce, or publically display any content from the Auctioneer's website without first obtaining written permission from the Auctioneer. 10. Closing: The Auctioneer's online auctions are designed to mimic traditional "live" actions. For this reason, this auction will have a staggered, dynamic closing. a. Staggered Closing: This online auction will automatically begin to close at a rate of one item per minute, every minute. Items' closing times may be extended past their scheduled closing time, however, as a result of the Auctioneer's dynamic closing feature. b. Dynamic Closing: The closing time of an item is automatically extended an additional two minutes whenever a bid is placed within the two minutes leading up to an item's scheduled closing time. 11. If you win an item in the auction you will be notified by email at the close of the auction. Scofield Auctions, Inc. will calculate your shipping costs based on your registration information, and send an invoice including all charges and fees. 12. All accounts must be settled within ten business days. 13. Chargebacks Prohibited: You agree that you will accept all charges placed on the credit card associated with your account, and you agree that you will not charge back any amount that the Auctioneer charges to your credit card. You agree that this provision applies equally to amounts charged in connection with any items you have won and any costs or fees discussed in Paragraph 11 of these Terms and Conditions. 14. Shipping & Handling - All items will be shipped by Scofield Auctions, Inc. via the US Postal Service Priority Mail Flat Rate boxes. An additional $5 handling charge will be added to each invoice. 15. The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 2% per month be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser's failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Carroll County, New Hampshire. 16. All sales are final. 17. By bidding on any item, the bidder shows acceptance of the terms of the auction. 18. The auction company reserves the right to refuse service or decline registration to any person. 19. The Auctioneer reserves the right to withdraw any item before the sale. 20. The Auctioneer reserves the right to postpone the auction. No one may have recourse as a result of any postponement.
