Please read the Proxibid Unified User Agreement ('Agreement') carefully, as it contains the terms and conditions that will govern your use of the Proxibid website and services. This Agreement constitutes a legally binding agreement between you and Proxibid. Your clicking on the button marked 'I ACCEPT' and your ongoing use of the Proxibid website (www.proxibid.com) indicates your acknowledgment that you have read, understand, agree to, and accept this Agreement. It is your responsibility to carefully read this Agreement before using this website or the Proxibid Services. If you do not wish to be bound by this Agreement, you may not use the Proxibid website or services.

ALL ITEMS ARE SOLD AS IS! Bidders are to rely on their own inspection and information. Any lot listed as 'Parts' or 'Scrap Metal' do NOT have a title/paperwork, is sold AS IS, and no support will be given to questions/problems regarding title nor registration. An asterisk '*' denotes that there is a title.
Lots with titles/paperwork will be described as such. Bidders are responsible for all fees regarding title transfer, inspection, and registration.
For live auction-style events, the Seller is allowing the Buyer to participate in the event through Internet prebidding and live bidding. The Buyer acknowledges and understands that such services may or may not function correctly the day of the event. Under no circumstances shall the Buyer have any kind of claim against the Seller or anyone else if the Internet service fails to work correctly before or during the live event. The Seller will not be responsible for any missed bids from any source. Buyers, who desire to increase the chance that their bid is acknowledged during a live event, should use the prebidding feature.
BY PLACING BIDS, YOU ARE AGREEING TO THE FOLLOWING TERMS AND CONDITIONS:

BUYERS ARE TO RELY SOLEY ON THEIR OWN INSPECTION AND INFORMATION
No refunds
All bidders are responsible to know what item they are bidding on.
The winning bidder of any item ENTERS INTO A BINDING CONTRACT and is expected to pay for all 'won' items, even if the bidding was done in error.
Everything MUST be PAID IN FULL on the day of the auction or payment discussed with the office, before removing any items!
**CAC reserves the right to withhold items until checks have cleared**
Items must be picked within 10 business days of the auction end.
**All online bidders CANNOT pick-up until Monday morning after the auction, due to having to download all online bids once the auction has concluded! **
Buyers Premiums:
5% per item for Items Won in the Live Auction (9% for Credit Cards!)
8% per item for all items won via HiBid & Proxibid (12% for Credit Cards!)
All Items must be removed within 10 business days or are subject to a $25 per day, per item storage fee! Items must be paid for by the following Tuesday or are subject to a $25 per day late fee. **WE WILL NOT LOAD OUT ON MONDAY, APRIL 8TH, DUE TO THE EXPECTED TRAFFIC FOR THE SOLAR ECLIPSE!!** PLEASE MAKE ARRANGEMENTS OTHER DAYS OF THE WEEK!!
We will prosecute any unresolved returned checks.
$75 returned check Fee applies.
Clark Auction Company, LLC is not responsible or liable for accidents or theft. Every effort is made to protect items after the bidding has ended, however, it is recommended that winning bidders guard their items at their own discretion.
