By registering to bid or placing a bid Bidder agrees to be bound by all of these terms and conditions and any other announced terms and conditions of sale or rules of the site. All internet bidders agree that bids placed on the Internet shall have the same legal effect as if they were in attendance at the auction in person. Bidders who bid from off-site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, value or any other determinative factor. Duncan Miller Company shall endeavor to describe in detail each item and any pertinent information about it. Duncan Miller Company is providing Internet pre-auction and live bidding as a service to bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall bidder have any kind of claim against Duncan Miller Company or anyone else if the Internet service fails to work correctly before or during the live auction. Duncan Miller Company will not be responsible for any missed bids from the source. This penalty must be paid to the Auction Company within 48 hours of the auction. 1) There is a 2% Internet Purchase Fee. Duncan Miller Company, LLC charges a 7% Buyer's Premium. Failure to make payment in full to the Auctioneer will result in a Penalty charge of 25% of the sale price plus all buyer fees and internet purchase fee. 2) Applicable State of ND Sales Tax will be charged on all Lots unless you are exempt from Sales Tax and you provide tax exemption form and exception certificates that are acceptable to the State of ND. 3) Payment in full must be made by November 30, 2018 in the form Cash, Wire Transfer, Cashier's Check or a Company Check accompanied with a bank letter of guarantee. The Auctioneer provides no guarantees or warranties (express or implied) in respect of the Equipment contained in the Lot.
