Payment Instructions: All public bidders will be required to have and leave a $1000 deposit in the form of cash or cashier’s check made payable to Greater Atlanta Auto Auction, LLC to be registered to buy and to receive a bidder number. If you are the winning bidder, the $1,000 deposit will retained and applied toward your purchase. Until final payment is made the deposit is non-refundable. ALL BIDS ARE FINAL & ALL LOTS ARE SOLD “AS IS WHERE IS” WITH ALL FAULTS AND DEFECTS. All vehicles will be charged an 8% in-person buyer fee and an additional 3% fee for internet purchases placed via Proxibid. GAAA will email all the paperwork that needs to be signed and returned to GAAA Monday, April 25,2022. At this time you will need to make arrangements for the final payment, due by 4:00 PM 04/25/2022. Credit/Debit Cards will not be accepted as payment for the final amount due for your purchases. GAAA will only accept wire transfers, personal or business checks with a bank certified letter, cash or certified funds as form of payment for your balance. (Vehicles/Titles will not be released until full payment is processed) The email address to return the paperwork will be on the cover page sent with your paperwork. If the final amount due is not paid, the initial $1,000 deposit will be applied as a restocking fee to GAAA. Should the bidder not purchase a lot, the 1000$ deposit will be returned to the bidder in the original form payment was received.
Deposit Requirements: Once you register for the auction a $1,000 deposit will be required in one of the forms listed above. This deposit may not be made with credit or debit card. If you are the winning bidder, the $1,000 will then be collected as a deposit toward your purchase. Until final payment is made a deposit is non-refundable.

Special Terms
Greater Atlanta Auto Auction, herein referred to as “GAAA” is only an auction service and is responsible only for the warranties and guarantees set forth herein.
BIDDER RULES
1. Purchaser agrees to accept ownership of merchandise/property upon receival of the winning bid and he/she freely assumes all responsibility and obligation for purchased lots at the time and without exception.
2. Purchaser’s Agreement: Winning Bidder agrees that he/she is solely responsible for paying in full the summation of the winning bid plus applicable buyer premiums for this event. Buyer agrees that no stop payment requests will be honored once payment has been tendered and any payments returned due to insufficient funds will be considered fraudulent with the intent to break the consigner/buyer purchasing contract.
3. All transactions are to abide by the Laws and Rules of Uniform Code of Georgia.
4. All units are sold singularly unless announced by the auctioneer.
5. The highest bidder is to be the buyer. In all cases of disputed bids, the lot shall be resold, but the auctioneer will use his judgment as to the good faith of all claims and his decision is final.
6. All items are offered for sale by Lot Number. The auctioneer will accept bids from the bidders present in the room and internet bidders. The auctioneer has the right to place a bid for consignor up to the reserve amount. Under no circumstances will the auctioneer place a bid on behalf of the consignor at or above the reserve. Further the consignor has the right to “lift” the reserve price whereupon it will be sold to the highest bidder at the hammer. When the reserve has been lifted, the auctioneer will duly announce it.
7. The purchaser will afford every opportunity to view all lots prior to sale. However, the purchaser must understand that he/she is buying property entirely based upon his/her own opinion. Units will be available to inspect prior to bidding. Units will not be eligible for test drives.
8.All lots are sold “AS IS WHERE IS”, with all faults and defects. Any documents or promises regarding lots are not guaranteed nor binding. Bidder acknowledges and agrees that GAAA is serving as a mode of service and all questions of authenticity, originality or condition are solely those of the consigner. Bidder should practice under his/her own discretion when determining the merit of these claims. Bidder understands and agrees any representations as to the history or condition of any vehicle are solely those of the seller and are not made by the Auction. The vehicle and information presented at the time of auction are final and supersedes any previous representations. The information provided is deemed reliable but is not guaranteed by GAAA.
9. Auctioneer records will serve as final say regarding any bidding disputes.
10. GAAA is not responsible for lost, stolen or damaged properties. Lots must be removed from the auction site by 12:00 p.m Sunday, April 24,2022. If not claimed, GAAA has the right to remedy, move and store at owner’s expense.
11. If a sale is not achieved, GAAA will act as a liaison between the buyer and seller to achieve a price that both consigner and seller may agree on. Any contracts formed in this manner will be sold by the same terms as lots sold on the auction block.
12. GAAA is entitled to any and all fees or commissions on any lot sold, due to or presented at an auction event up to 21 days after said event. GAAA is not responsible for any and all liabilities, third-party or otherwise.
13. If forced to seek legal assistance in the enforcement of Sell/Buy Agreement, GAAA will be entitled to any fees that occur.
14. Payment methods for vehicle purchases include personal or approved business check, cashier’s check, cash, and wire transfer. NO CREDIT CARDS will be accepted for the payment of a vehicle. All purchases made by sellers will be deducted from the seller proceeds unless arrangements have been made with GAAA staff.
15. GAAA does not guarantee miles or mileage on these vehicles or any documents related to these vehicles.
16. Upon being awarded high bid, purchaser is responsible to pay end hammer price plus any applicable premiums. Non-payment will deem purchaser liable for any losses incurred in the resale of said lots to include, but not inclusive of freight, storage, difference in received value or auction fees.
17. Purchaser authorizes, without further notice, GAAA to recover any deficiencies due to seller and/or GAAA and to charge purchaser for said amount(s).
18. If the buyer fails to comply with any of the Terms & Conditions, GAAA may, in addition to resorting to remedies available by law including the right to hold such defaulting buyer liable for the purchase price (i) cancel the sale, retaining as liquidated damages any payment made by the buyer, (ii) resell the property without reserve at public auction or privately on seven day notice to the buyer or (iii) take such action that we deem necessary or appropriate. If GAAA resells the property, the original buyer shall be held liable the difference in purchase price and all costs and expenses, including warehousing, the expense of both sales, responsible attorney’s fees, commission, incidental damage and all other corresponding charges. If the buyer pays a portion of the purchase price for any of all lots purchased, GAAA shall apply the payment received to such lot or lots that GAAA, in our sole discretion, deems appropriate. Any buyer who fails to comply with these Terms & Conditions will be deemed to have granted GAAA a security interest in his/her purchased lots. GAAA may retain these partial payments as collateral against the buyers obligation to remedy outstanding responsibilities toward the auction pertaining to any property in GAAA possession owned by the buyer. GAAA shall have benefit of all rights of a secured party under the Uniform Commercial Code adopted in the state where the auction is held. This agreement shall be governed by and interpreted under the laws of the state of Georgia. By agreeing to the Terms & Conditions, both parties understand that any action that must be taken to enforce the terms of this agreement shall be brought forth in the Circuit Court of Winder, Georgia.
19. Any litigation brought forward by bidder/purchaser will be against seller. GAAA is only performing an auction service and does not own the property. Upon litigation, bidder/purchaser will not be entitled to recovery fees earned by GAAA duly performing its service.
20. ALL BIDS ARE FINAL AT AUCTION. Upon receival of the winning bid, the buyer is solely responsible for the merchandise and all costs/responsibilities associated with the lot.
21. Transactions may be subject to local and state sales tax.
22. Titles on purchased lot will be processed and mailed within 14 business days after auction contingent upon confirmed payment.
23. Final payment due by 4:00 PM 04/25/2022. If making multiple purchases please consult with the auction bidder registration staff on how to make a single payment versus multiple payments.
24. Under no circumstances is any vehicle to be sold on the auction property without authorization from the auction. The parking lot is not a sale lot. Failure to comply may result in revoked buying and selling privileges.
ONLINE BIDDER RULES
1. All bidder rules listed above apply to online bidders with the addition of the rules that follow.
2. All sales whether live or online are “AS IS WHERE IS” with all defaults and defects and the purchaser is responsible for any inspection or lack thereof. All sales are final.
3. Online bidders agree to hold GAAA and its employees not at fault for any issues arising from the nature of the absentee bidder process.
4. It is the responsibility of the purchaser to secure proper transportation for any purchased vehicles. GAAA can suggest appropriate transport companies but it is the purchaser’s responsibility to remove vehicles between the close of the sale and 12:00 pm Sunday, April 24,2022.
5. No bids will be taken from unregistered bidders.
6. GAAA makes and provides no guarantee or assurance GAAA’s internet bidding services will operate without interruption or that all services, products, features, functions, content or operations will be available or perform as described or at any particular time or times. GAAA is not responsible or liable for 1) Malicious code, delays, inaccuracies, errors, omissions or mistakes arising out of bidder’s use of GAAA’s internet bidding services 2) Any interruption or cessation of transmission to or from our website 3) Any bugs, viruses, Trojan horses or the like which may be transmitted to or through our site by any third party, or 4) The defamatory, offensive, infringing, breaching, fraudulent or illegal conduct of other users or third parties. Bidder acknowledges and agrees he/she is assuming the entire risk of using GAAA’s internet bidding services and the features and functions associated with GAAA’s internet bidding services.
