Harris Estate Services, LLC - Terms & Conditions - Timed Auctions 1. GENERAL: ALL SALES ARE FINAL and all lots are sold as shown and 'AS IS,' with all faults, imperfections, and errors of description. While Harris Estate Services, LLC, its employees and representatives, make every effort to accurately describe all lots offered for sale, it is incumbent upon the bidder to satisfy themselves in all areas of authenticity, originality, condition and imperfections. Harris Estate Services, LLC, their employees and/or agents are not responsible for errors or omissions in description, genuineness or authenticity, and fault or defect in any lot. No warranties or representations whatsoever are given by Harris Estate Services, LLC, its employees and/or agents, to any buyer in respect to any lot. Bidders should also acknowledge that condition descriptions are often subjective and any item offered at auction may be subject to normal wear consistent with age that may not be specified in a condition description. It is the buyer's responsibility to know what shipping costs are before bidding. Harris Estate Services reserves the right to add or delete items throughout the auction. Items sold at timed auctions must be picked-up at the assigned time, No Exceptions. 2. PREVIEW of ITEMS: A preview period will be held for this auction. BUYER'S PREMIUM: A buyer's premium of 15% shall be added to each purchase to reach the total sales price. 4. SALES TAX: Purchases by bidders that live within the boundaries of South Carolina are subject to the collection of state and local sales taxes. Unless an item is exempt by SC law (such as coins and currency), SC sales tax of 6% will be charged based on the total of the winning bid + buyer's premium and shown on the invoice for SC residents. For sales tax exemption the buyer must provide Harris Estate Services, LLC with a valid South Carolina Retail License Number and properly completed ST-8A Certificate of Exemption. 5. FORMS of PAYMENT: Acceptable forms of payment are Visa, MasterCard, Discover and American Express. You will be required to register your credit card with Proxibid before bidding. All items will be charged to credit card on file immediately following end of auction. Other payment terms (such as cash, checks, money orders, bank wires) must be approved by auctioneer at least 72 hours (3 days) before the auction ends. No cash, checks, money orders, Paypal or other forms of payment will be accepted unless previous arrangements have been made before the auction ends. 6. INVOICING and PAYMENT COLLECTION: Complete payment is required immediately after you receive an invoice once the timed auction has closed. We will charge your credit card within 24 hours after the timed auction has closed. Item(s) not paid for within 48 hours (2 days) after bidding on the lot has closed are deemed noncollectable and a non-paid item. In this event, the winning bidder forfeits the item. 7. ITEM PICK UP: Paid items must be picked up at the date, time and place noted in the section entitled "Checkout Date & Times". Please note that we require one day to process invoices and collect payments for timed auctions. Your items will be released as soon as payment clears. Items must be picked up at the assigned times. Harris Estate Services reserves the right to charge additional fees to meet a buyer on another pickup date/time. PLEASE BE AWARE THAT THE TERMS OF SALE REQUIRE THE BUYER TO BE RESPONSIBLE FOR MOVING AND LOADING ALL OF YOUR ITEMS AT PICK UP. ANY ASSISTANCE HARRIS ESTATE SERVICES, LLC MAY BE ABLE TO OFFER IS AN ADDITIONAL SERVICE. PLEASE ALLOW TIME TO LOAD LARGE ITEMS BEFORE PICK UP TIME IS OVER AND BRING HELP FOR LOADING HEAVY ITEMS. 8. SHIPPING: If you are not able to pick up your item and require your item to be shipped to you, we will be pleased to cooperate with a third party shipper at your request. Your items will be released to the shipper as soon as payment clears. We can recommend third party shippers that will provide services and bill you directly. PLEASE SEE THE SECTION 'SHIPPING INSTRUCTIONS' FOR DETAILS ABOUT SHIPPING AND RECOMMENDED THIRD-PARTY SHIPPERS. IF YOU ARE NOT ABLE TO PICK LARGE ITEMS UP, YOU WILL NEED TO SPECIFY A FREIGHT SHIPPER TO PICK UP YOUR ITEM FOR YOU. 9. REMOVAL of PROPERTY: All property must be removed from the sale premises by the purchaser at their expense no later than 2 business days following its sale and, if property is not removed, Harris Estate Services, LLC reserves the right to charge a minimum storage fee of $5 per lot per day or to deliver said property to a public warehouse for storage at the purchaser's expense. HARRIS ESTATE SERVICES RESERVES THE RIGHT TO CHARGE ADDITIONAL FEES TO MEET A BUYER ON ANOTHER PICKUP DATE/TIME. Harris Estate Services, LLC shall have no liability for any damage to property left on its premises or on the sale premises for more than 2 days following the end of auction. Unless arrangements have been made with Harris Estate Services, LLC, property not removed after forty (40) calendar days from the end of auction date may be deemed abandoned by winning bidder and shall be owned by Harris Estate Services, LLC. 10. WINNING BIDDER: The highest bidder shall be the buyer. The record of sale, as kept by the auctioneer, will be taken as absolute and final in all disputes between two or more bidders. The auctioneer will determine the winning bidder and the auctioneer's decision will be binding and final. 11. RESERVES: Reserves may be used, however, most lots are offered with no reserve price. A reserve is a minimum price below which such a lot will not be sold. 12. BIDDING: All items are sold by online timed auction only. Harris Estate Services, LLC is not responsible for internet connection problems or website issues that cause missed bids. Timed auction bidders who desire to make certain their bid is accepted should use the maximum bid (automatic bid) feature of the timed auction system and leave their maximum bid at least 24 hours before the auction ends. The auction end time for a specific lot will be extended if that lot receives bids before the auction lot closes. We reserve the right to decline bidding registration to any person. 13.
