Harris Estate Services, LLC - Terms & Conditions - Timed Auctions LOT 1 IN THIS AUCTION IS AN “INFORMATION ONLY” LOT AND DOES NOT REPRESENT ANY PROPERTY OR INFORMATION FOR SALE AT AUCTION. DO NOT BID ON LOT 1. Any bids placed on LOT 1 will not be honored. 1. GENERAL: ALL SALES ARE FINAL and all property is sold as shown and 'AS IS,' with all faults, imperfections, and errors of description. While Harris Estate Services, LLC, its employees and representatives, make every effort to accurately describe all property offered for sale, it is incumbent upon the bidder to satisfy themselves in all areas of authenticity, originality, condition and imperfections. We strongly encourage bidders to preview items. Harris Estate Services, LLC, their employees and/or agents are not responsible for errors or omissions in description, genuineness or authenticity, and fault or defect in any property. No warranties or representations whatsoever are given by Harris Estate Services, LLC, its employees and/or agents, to any buyer in respect to any property. Bidders should also acknowledge that condition descriptions are often subjective and any property offered at auction may be subject to normal wear consistent with age that may not be specified in a condition description. It is the buyer's responsibility to know how much shipping costs are before bidding. Harris Estate Services reserves the right to add or delete property throughout the auction. Property sold at timed auctions must be picked-up at the assigned time--No Exceptions. 2. PREVIEW: A preview period will be held for this auction event. BUYER'S PREMIUM: Unless otherwise noted in the items description, a buyer's premium of 15% shall be added to each sold lot's winning bid hammer price to reach the total sales price. 4. SALES TAX: Purchases are subject to the collection of state and local sales taxes. Unless property is exempt by state law or bidder has a retail sales tax number for bidder's state, then sales tax for bidder's state and locality will be charged BY THE NEW PROXIBID INVOICING SYSTEM based on the total of the winning bid + buyer's premium and shown on the invoice. For SC sales tax exemption bidder must provide Proxibid AND Harris Estate Services, LLC with a valid South Carolina Retail License Number and properly completed ST-8A form. 5. FORMS of PAYMENT: Acceptable forms of payment are Visa, Master Card, Discover, American Express and cash money. You will be required to register your credit card with Proxibid before bidding. Checks, money orders, Paypal or other forms of payment will NOT be accepted unless previous arrangements have been made with Harris Estate Services LLC three (3) days before the auction event ends. Cash money payments at pickup are accepted. 6. INVOICING and PAYMENT COLLECTION: NOTE THAT UNDER THE NEW PROXIBID INVOICING AND PAYMENT SYSTEM THE WINNING BIDDER MUST TAKE THE INITIATIVE TO PAY THE INVOICE USING THE BLUE "PAY NOW" BUTTON ON THE INVOICE. PROPERTY WILL NOT BE RELEASED UNTIL PAID FOR. Please use the blue PAY NOW button on your invoice to make payment by credit or debit card. --BIDDERS PAYING WITH CASH: Bidders paying in cash at pickup MUST NOTIFY Harris Estate Services by text message at 864-238-2942 before the auction closes. --COMPLETE PAYMENT IS REQUIRED WITHIN 48 HOURS (2 days) after bidding on the property has closed (SOLD). Property not paid for within 48 hours shall be deemed uncollectable and, in that case, the winning bidder forfeits the unpaid property. --FOR BIDDERS WANTING THEIR PROPERTY SHIPPED: In order for your property to be released to the shipper, the billing address of the credit/debit card used to make payment for the property must match the shipping address. Any exception will require approval from the auctioneer (Harris Estate Services) BEFORE payment is made. Bidder will pay the third party shipper directly for shipping costs. 7. Property PICK UP: Property paid for must be picked up at the date, time and place noted in the section entitled "Checkout Date & Times". Property must be picked up at the assigned times. PLEASE NOTE WELL THAT BUYER IS RESPONSIBLE FOR LOADING ALL BUYER'S PROPERTY AT PICK UP. Please allow time to load large items and bring help for loading heavy items. We suggest using local contractors that provide moving services for furniture if you are unable to move items yourself. Harris Estate Services LLC is not responsible for damage that may occur to buyer's property when property is loaded. Buyer is also responsible for packing breakable items such as glass, etc. PROPERTY THAT THE UPS STORE WILL SHIP AND THAT IS NOT PICKED UP WILL AUTOMATICALLY GO TO THE UPS STORE IN TAYLORS, SC WITHIN 24-48 HOURS AFTER THE SCHEDULED PICKUP TIME IS OVER. You may pick up your property at the UPS store at your convenience or request the UPS store to ship your property. PLEASE NOTE THAT THERE IS A SMALL FEE CHARGED BY THE UPS STORE FOR STORAGE SERVICE. PLEASE NOTE THAT LARGE ITEMS THAT CAN NOT BE SHIPPED BY UPS MUST BE PICKED UP WITHIN TWO (2) DAYS OF THE END OF AUCTION DATE. SEE SECTION 9 BELOW. 8. SHIPPING: If you are not able to pick up your property and require your property to be shipped to you, we will be pleased to cooperate with a third party shipper at your request. We can recommend third party shippers that will provide services and invoice you directly. PLEASE SEE THE SECTION 'SHIPPING INSTRUCTIONS' FOR DETAILS ABOUT SHIPPING AND RECOMMENDED THIRD-PARTY SHIPPERS. IF YOU ARE NOT ABLE TO PICK LARGE ITEMS UP, YOU WILL NEED TO SPECIFY A FREIGHT SHIPPER TO PICK UP YOUR PROPERTY FOR YOU. Please note that property identified as "LOCAL PICKUP ONLY" in the description will not be shipped. 9. REMOVAL of PROPERTY: All property must be removed from the sale premises by the purchaser at their expense no later than two (2) business days following its sale. Harris Estate Services LLC shall have no liability for any damage to property left on its premises or on the sale premises for more than two (2) days following the end of auction. Unless arrangements have been made with Harris Estate Services LLC, property not removed after two (2) calendar days from the end of auction date shall be deemed abandoned by winning bidder and winning bidder forfeits any right to the property. For property that arrangements have been made for Harris to store longer that two (2) days after the end of auction date, Harris Estate Services will charge $10 per large size auction lot per day. Harris Estate Services LLC reserves the right to charge additional fees to meet a buyer for property pickup on a date later than the scheduled pick up date. 10. WINNING BIDDER: The bidder submitting the highest bid as determined by the auctioneer shall be the winning bidder / buyer. The record of sale, as kept by the auctioneer, will be taken as absolute and final in all disputes between two or more bidders. The auctioneer will determine the winning bidder and the auctioneer's decision will be binding and final. 11. RESERVES: A reserve price is a minimum price below which a lot will not be sold. ALL LOTS are with reserve and auctioneer may withdraw any lot at any time until the lot is sold. If the auctioneer withdraws a lot from bidding and does not drop the hammer on that lot, then that lot is NOT sold. 12. BIDDING: All property is sold by online timed auction method only. Harris Estate Services LLC is not responsible for internet connection problems or website (AUCTION PLATFORM) issues that cause missed bids. Timed auction bidders who desire to make certain their bid is accepted should use the maximum bid (automatic bid) feature of the timed auction system and leave their maximum bid at least 24 hours before the auction ends. The auction end time for a specific lot will be extended if that lot receives bids right before the auction lot closes. We reserve the right to decline bidding registration to any person. 13. AGREEMENT TO TERMS and CONDITIONS: Your bidding at this Auction event indicates that you have read and accept these Terms of Sale.
