In order to be approved for this auction, Proxibid and the Auctioneer require one of the following: • Valid credit card • Bank letter of Payment Guarantee Auctioneer acknowledges and agrees that the above information is confidential and proprietary to Proxibid and otherwise constitutes trade secrets of Proxibid, and Auctioneer will not use such information other than for the purpose of invoicing bidders and will not disclose such information to any person or entity without the prior express written consent of Proxibid. Auctioneer further acknowledges that any actual or threatened use or disclosure of this information in a manner inconsistent with the terms of The Agreement for Online Bidding Service will cause irreparable harm to Proxibid, for which Proxibidshall be entitled to immediate injunctive relief without the need to post a bond or other security. Such bond and/or security requirement is hereby waived. Failure to pay for the item(s) that you are the successful bidder on will result in a penalty in the amount of 25% of the purchase price of the item(s). Cochran Auctioneers charges 10% on each item selling for $5,000 or less & a flat fee of $500 on each item selling for $5,001 or more. There is an additional 1% admin fee added to all lots. Please note the state of MD only accepts MD Tax Numbers. All others must pay tax. TITLE POLICY: There is a $35.00 handling charge per titled vehicle and/or trailer on all titled items. If a title cannot be supplied for an item that was sold with a title, the Purchaser is entitled only a refund of the purchase price upon return of item. Any work done on the vehicle before receipt of the title is AT YOUR RISK! ALL TITLES (as settled upon) will be certified mailed AFTER 10 banking days! The Auctioneer and Proxibid undertake no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact. 9) Each and every Lot is sold "as is, where is". The Auctioneer and Proxibid provide no guarantees or warranties (express or implied) in respect of the Equipment contained in the Lot. All representations made by the Auctioneer and Proxibid, its servants or agents are to be considered lay opinions only and the Auctioneer and Proxibid accept no liability for any purchase made by a Buyer in reliance upon them. 10) The Buyer agrees to insure the Equipment purchased against all losses from the Auction Date until removal of the Equipment by the Buyer. 11) The Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth. 12) Title Policy: J.
