Terms and Conditions
TERMS & CONDITIONS: By accepting the terms and conditions of this auction you acknowledge you are entering into a legal and binding contract. You agree to abide by all terms and conditions and you acknowledge receipt of all explanations and information made available by Janzen Auction Inc., also referred to as Janzen Auctioneers. By entering into this Agreement Purchaser hereby certifies that Purchaser is at least 18 years old and under no legal limitations with respect to Purchaser?s ability to enter into binding contracts. Purchaser?s registration as a bidder shall act as your acceptance to all terms and conditions of this Agreement. Janzen Auctioneers is under no obligation to provide Purchaser with notice that Purchaser?s registration has been accepted in order to bind Purchaser to the terms and conditions of this Agreement. Janzen Auction, Inc. acts merely as agents for sellers. This Auction is with reserve unless specifically stated otherwise. Auctions are with undisclosed reserves unless advertised otherwise as "Absolute." Auctioneers, at their discretion, may place a reserve bid on behalf of the seller. No warranties are expressed or implied as to any items being sold. Any implied warranties by statue or common law are hereby expressly waived. You agree to purchase and accept the item in an as-is condition. Information on items is obtained by us from the sellers and you hereby agree to hold harmless Janzen Auction, Inc. for any errors or omissions regarding the item(s) being sold. This information includes but is not limited to year, model, machine or engine hours, physical condition, options, features and other data related to the value of the item. All items are sold As-Is-Where-Is unless specific factory or seller issued warranties are listed in the item description. Purchaser agrees and acknowledges that any photographs or images with respect to auction goods may not accurately depict the true condition of the machinery or equipment. It is the Bidder?s responsibility to determine condition, age, genuineness, value or any other determinative factor. Janzen Auctioneer?s may attempt to describe the merchandise in advertising, on the internet and at the auction but makes no representations. In no event shall Janzen Auctioneer?s be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. You acknowledge that you have the right, responsibility, and opportunity to inspect the item(s) personally, or to have a third-party representative inspect the item(s) for you. That by bidding on an item you have agreed to accept that item in its present condition at its present location and with the description provided whether accurate or not. Janzen Auctioneer?s is providing internet pre-auction and internet bidding as a service to the Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Janzen Auctioneer?s or anyone else if the internet service fails to work correctly before or during the auction. Janzen Auctioneer?s will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours prior to the end of the auction. Janzen Auctioneer?s reserves the right to withdraw or re-catalog items in this auction. Bidders who bid using the internet or are unable to preview items understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder?s responsibility to determine condition, age, genuineness, value or any other determinative factor. Janzen Auctioneer?s shall attempt to describe in detail each item and any pertinent information about it. Janzen Auctioneer?s will not be responsible for any errors or omissions in the description of the merchandise. Bidder agrees that everything is sold as is and that they may not return any item they purchase for any reason. When using the online auction services, you are making a firm commitment to purchase said item(s) and are entering into a legal and binding contract. Bids may not be cancelled or retracted for any reason. Bidder acknowledges responsibility for any personal injury or property damage caused by bidder or his Agent, and further agrees to hold Janzen Auction, Inc., or it?s Owners, its Officers, or Employees harmless for any personal injury to himself or his Agents and any personal damage incurred on auction premises. Non-paying bidders or fraudulent bidding will subject you to legal recourse and possible criminal charges including any fraud and/or interstate commerce violations. Purchaser shall be responsible for all attorney?s fees and costs incurred by Janzen Auction, Inc. in the event a buyer default. Janzen Auction, Inc. may deem a buyer's failure to claim and remove equipment within 60 days following the close of an auction as evidence of buyer's intention to abandon the property. In these instances, the Company may take action that is adverse to buyer's interest in the property, including, but not limited to steps to dispose of the property. For those items with a final selling price of $3,000 or less, the Company will determine the appropriate disposition approach which may include, Removing and disposing as the Janzen Auction, Inc. sees fit, Allowing seller to retain or scrap, Sell the item(s), whereby the Company will remit the sales proceeds to the buyer, less selling and advertising expenses, storage costs, plus 25% administrative fee. For those items with a final selling price of greater than $3,000, Janzen Auction, Inc. may remove the item from the selling location and resolve as follows. The Company may reimburse the seller on the buyer's behalf for storage fees of $25 per day, with the total amount not to exceed $1500. Sell the item(s), whereby the Company will remit the sales proceeds to the buyer, less selling and advertising expenses and storage costs, plus 25% administrative fee. If a buyer with the winning bid has not removed the purchased item(s) from selling location within 10 business days after the close of the auction, the buyer will be responsible for directly paying the seller any and all storage fees if levied by the seller. If levied by the seller, storage fees will be $25 per day beginning the 10th day after the close of the auction/winning bid. Purchaser agrees to defend, indemnify and hold Janzen Auction, Inc. and our and their employees, contractors, agents, officers and directors harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses.
Firearms
All Property is sold "As Is" "Where Is" with no guarantees or warranties, and all sales are final. All people attending the Auction and removal of merchandise assume all risks of damage to property or person and release the responsibility of Janzen Auctioneer's from any liability. All internet bidders agree to pay 15% of the hammer price for each lot/item they purchase. The property will be open public inspection. It is the bidder's responsibility to determine the condition of the item they may be bidding on. Janzen Auctioneer's will attempt to describe the item through print ad, internet, and the day of auction to the best of there knowledge, but it is the responsibility of the bidder to determine that factor. Janzen Auctioneer's in no event will be held responsible for implied or having made any warranty of said merchandise. The best way to view items being sold is on sight, so bidders bidding off sight understand they may not be able to inspect items as well as seeing them in person. Janzen Auctioneer's will do the best to describe each item to the best of there knowledge. Janzen Auctioneer's will not be responsible for any error's or omissions in the description of items, with bidder agreeing everything is sold "AS IS" "Where Is". Janzen Auctioneer's provides internet bidding to a service to the buyer providing both internet and live bidding, and bidder understands that internet bidding may or may not faction correctly there day of auction, with no claim being directed towards Janzen Auctioneer's if this function does not work correctly on the day of the sale. Proxi internet bidders who want to make certain there bid isn't missed should leave a max bid 48 hrs prior to auction day. Janzen Auctioneers will not be responsible for any missed bids of any source. When items are sold the buyer assumes all responsibility for there item. All items must be settled for in full at the conclusion of the Auction and nothing will be removed until settled for. Packing and shipping costs are the responsibility of the buyer and maybe quoted prior shipping. All items will be insured for the purchase price. Bidders agree to provide any identification that Janzen Auctioneer's may require including but not limiting driver?s license S.S. #, photo copies of credit cards or passport. If there are any questions of merchandise please contact us well in advance of the live auction. Buyers must comply with there local state laws regarding items being sold. Due to gun laws Janzen Auctioneers will not sell or ship to international bidders including Canada. All FFL's should be emailed to jerjanzen77@gmail.com please include your paddle number with it. Internet buyers may purchase a firearm without an FFL, but note that the Firearm will be shipped from us an FFL dealer to an FFL dealer and said buyer must complete proper FFL forms from the FFL licensee in said buyer?s state, this includes handguns.
