Payment Terms
Accepted forms of payment are cash, check (payable to MacFadden & Sons Inc.), or wire transfer. Payment is due within 72 hours of auction close.
Ownership and Responsibility
Once the auctioneer announces "sold," the highest bidder becomes the full and rightful owner of the item. The buyer is responsible for the item from that moment on. MacFadden & Sons Inc. reserves the right to accept or reject any bid for any reason. We are not responsible for missed bids or any damage to items before or after they are sold.
All Sales Are Final
All items are sold "as is, where is," and all sales are final. No returns or refunds are accepted. Buyers are encouraged to inspect items before bidding. It is the buyer’s responsibility to determine the condition, age, value, or any other important details about the item. MacFadden & Sons Inc. tries to provide accurate descriptions but does not guarantee the quality, condition, or merchantability of any items. There are no warranties, either expressed or implied.
Pick-Up Times
Pick-up times are generally Monday-Friday, 8 AM - 4 PM, and Saturday, 8 AM - 11 AM. These times may change depending on the sale, so please contact the auction house for the exact pick-up schedule for your auction. The auctioneer will also announce pick-up days and times at the start of each auction. You may also refer to the 'Payment Instructions' section above for details.
Pre-Bidding
Placing a pre-bid does not remove your responsibility as the buyer to stay informed about all announcements made during the live auction. Auctions are still live, and important announcements are often made during the sale. Auctioneer announcements always take precedence over any written terms. MacFadden & Sons Inc. will not be held responsible for announcements you miss due to placing a pre-bid.
For timed auctions, it is your responsibility to:
1. Clarify all questions or concerns before bidding.
2. Review the lot descriptions and information for items you’ve pre-bid on before the auction begins.
Remote Bidders
If you are bidding online or offsite, understand that you may not be able to inspect items as thoroughly as those who attend the auction in person. It remains your responsibility to assess any item's condition, value, or other factors. MacFadden & Sons Inc. is not liable for any errors or omissions in item descriptions.
Online Bidding
MacFadden & Sons Inc. provides online and proxy bidding for convenience, but we do not guarantee that these services will function properly. We are not responsible for missed bids, technical issues, or internet failures. For secure bidding, we recommend using the proxy-bidding feature and placing your maximum bid at least 24 hours before the auction begins.
Auction Catalog & Changes
The auction catalog is provided as a guide only. MacFadden & Sons Inc. reserves the right to group, add, remove, or change the quantity of lots at any time. Announcements made on the day of the sale take precedence over any prior written or advertised terms, but these announcements do not change the core terms and conditions of the sale.
Vehicle Documents
Buyers are responsible for verifying that all provided documents meet their satisfaction before the auction begins. If further paperwork is required, the Buyer is responsible for coordinating directly with the Seller to arrange a mutually agreeable time and location for completion. All vehicles under 26,000GVW will be subject to NYS sales tax unless a Sales Tax Exemption Form is provided, (ie Resale, Agricultural, Non Profit, etc.) A $100 handling fee applies to lots sold with a Certificate of Title (registration documents exempt). For cash payments, paperwork will be provided at checkout; for all other payment types, paperwork will be mailed via USPS Priority within 10 business days.
Buyer Responsibility
By bidding, buyers confirm that they have inspected or waived their opportunity to inspect the items being sold. The buyer agrees to hold MacFadden & Sons Inc. harmless from any claims, costs, or legal fees related to the condition or use of purchased items, including the buyer’s failure to follow manufacturer instructions or warnings. There is no warranty on any item, and MacFadden & Sons Inc. is not responsible for verifying equipment hours, usage, or whether an item includes its original manual or safety equipment. It is the buyer’s responsibility to ensure that the equipment complies with safety standards before use.
Final Record of Sale
The sales record kept by the auctioneer and clerk will be taken as final. Once the hammer falls, it is non-refundable. For any questions, please contact MacFadden & Sons Inc. at 518-284-2090.
