RED BIRD TERMS AND CONDITIONS REGISTRATION: All prospective buyers are required to register prior to the auction and/or prior to bidding at www.bidredbird.com. A valid driver’s license is required. A buyer number will be provided at registration. By signing the registration agreement, Buyer is accepting all terms and conditions set forth below. JUDGMENT OF ITEM OR PROPERTY SOLD: All property sells as is, where is, without warranty of any kind, expressed or implied. Some items are absolute and some have a reserve. There are not and will not be warranties on quality, character, or condition of any item sold in auction. Bidders shall inspect items prior to bidding and determine the condition for itself. Red Bird Auction Company offers no warranty on any item or property sold whatsoever. BUYER’S CATALOG: All descriptions and conditions of equipment in catalog (online or in print) are believed to be correct and accurate and have been provided by the Seller. Notwithstanding, neither the Seller nor Red Bird Auction Company are responsible for errors in descriptions or condition. Year, model, mileage, meter reading, and condition are not guaranteed. Buyer accepts responsibility to inspect and verify item status prior to bidding. Manufacturer warranties listed in the catalog are provided by the Seller to Red Bird Auction Company and are not verified. Buyer must verify such information for themselves. Red Bird Auction Company is in no way responsible for discrepancies. The catalog acts as a guide only. ITEM INSPECTION: The buyer agrees to rely on personal inspection of any item in auction. RISK OF LOSS: The buyer assumes full responsibility and risk of loss for all items purchased from the time auctioneer declares items Sold to Buyer. PAYMENT TERMS: Payment for item(s) must be tendered to Red Bird Auction Company on date of sale unless arranged prior to auction in writing. Cash, cashier’s checks, and certified checks are accepted. Business and personal checks are accepted only if accompanied by a current bank letter guaranteeing payment to Red Bird Auction Company. Wire transfers are accepted, provided that Buyer shall be responsible for a wire fee of $30.00 payable to Red Bird Auction Company. Credit cards are accepted provided the buyer agrees to not stop payment from credit card company and pay the 3.5% transaction fee to Red Bird Auction Company. The buyer agrees to not remove the item from the auction yard or item(s) current location until full payment is received, cleared, and a Release Ticket/Form is obtained from Red Bird Auction Company. TAXES & TITLES: All items are subject to state and local tax laws. If a buyer is exempt from sales tax, Red Bird Auction Company must have copy of Sales Tax Certificate prior to payment. Failure to do so will result in the buyer paying current sales tax rates. Titles will be mailed within ten (10) business days of receipt of payment unless otherwise disclosed by Red Bird Auction Company. OFFICE & AUCTION SITE HOURS: The Red Bird Auction Company office is open Monday through Thursday from 8:30 am to 3:30pm. Subject to change without notice. Auction site hours for inspection will be the same as office hours for two weeks prior to auction day. All pick up and deliveries must have prior approval. Pick up times are during office hours ONLY! Red Bird Auction Company will provide practical loading assistance up to 10 business days of purchase. After that, buyers will be responsible for loading out. All off-site items, load outs will be subject to Seller’s availability. All Inoperable items load outs will be sole responsibility of Buyers. ITEM REMOVAL/RELEASE: Items shall only be removed from the auction yard by the buyer once the buyer has paid in full for items bought and has received a release ticket/form from the front office or emailed if purchased via online. All items, obtained locally or remotely, must be retrieved within fourteen (14) days of the auction date unless otherwise agreed upon by Red Bird, Seller and Buyer. If the item(s) is not retrieved within 14 days of auction date or other arrangements made, the buyer/owner will be charged a twenty-five dollar ($25) fee per day as an item storage fee. Items not retrieved within thirty (30) days of the original auction date will be sold absolute in the next auction. Additionally, should a Buyer be required to retrieve the item directly from the Seller or Possessing Third Party, Buyer shall provide no less than a forty-eight (48) hour notice to Seller and/or Possessing Third Party, and all parties shall mutually agree on the time and date of retrieval. AUCTION SITE: Buyers acknowledge that the auction site and anywhere the property is being sold or displayed is a potentially dangerous place and at all times shall be at their own risk with no notice of the conditions of the premises. BUYER’S FEES: A 10% buyer’s fee is applied to all item(s). Buyer’s fee is capped at $7,500.00 per item and will not exceed such on items sold greater than $75,000.00. There will be an additional 2% fee for all online purchases. ADDITIONAL FEES: As of March 31st, 2025, there will be a Domestic Wire Fee charge of $15.00 and International Wire Fee charge of $40.00 added to all payments made by wire.
