Special Terms
All firearms sales are recorded as required under ATF Requirements. As an FFL Licensee, Red Rock Auctions may ship firearms only to other FFL Licensees, ABSOLUTELY NO EXCEPTIONS! ONLY TYPE 1,2,7, & 10 FFL LICENSES WILL BE ACCEPTED. CURIO & RELIC LICENSES WILL NOT BE ACCEPTED!
BUYERS RESPONSIBILITY:
1. Contact their preferred FFL dealer and request that a signed copy of their FFL be sent/emailed to RED ROCK AUCTIONS. At (info@redrockauction.com) (RRA will not be responsible for contacting the FFL dealer, and requesting an FFL, on your behalf)
2. Pay for the firearm in full, including bid price, buyer’s premium, sales tax, and firearms administration costs. You are responsible for paying all shipping costs, upon receiving a separate invoice.
3. Please contact RRA with any questions, concerns, or clarifications.
TRANSFER INFORMATION & FFL REQUIREMENT:
ALL TRANSFER INFORMATION AND FFL’S MUST BE RECEIVED ON OR BEFORE 5 DAYS AFTER THE AUCTION CLOSES. AFTER THIS DATE, ITEMS ARE CONSIDERED ABANDONED AND ARE LOST TO THE BIDDER, WITH OUT REIMBURSMENT. RED ROCK AUCTIONS IS WILLING TO MAKE ARRANGEMENTS AS LONG AS THE BUYER COMMUNICATES, BY EMAIL (INFO@REDROCKAUCTION.COM) WITH RED ROCK AUCTIONS PRIOR TO THE 5 DAY DEADLINE. FIREARMS WILL ONLY BE TRANSFERRED TO A CURRENT FFL HOLDER. THE FFL MUST INCLUDE YOUR NAME, BIDDER NUMBER AND INVOICE NUMBER FOR THE BIDDER.
This is a legal agreement between you, the user or buyer, and Red Rock Auctions LLC. (RRA). You should read this agreement carefully before accepting its terms. If you have any questions regarding the meaning or application of this Agreement, please direct your questions to: RED ROCK AUCTIONS LLC. 3550 W. Cheyenne Ave., Suite 120 North Las Vegas, Nevada 89032 or info@redrockauction.com. The bidder must be at least 18 TO 21 years old to bid on any offering (DEPENDING ON ITEM AND RESIDENCE LOCATION). When you click on the Online Form to become a bidder, you will be redirected to Proxibid.com and you must agree to the Proxibid Unified User Agreement. You are bound by the obligations of that agreement, in addition to the obligations of the Red Rock Auction Agreement. DO NOT BID IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OR YOU ARE NOT ABLE TO PAY FOR YOUR ITEMS WITHIN THE SPECIFIED TERMS OF EACH AUCTION.
The following terms are defined for use in this agreement, and their meaning in this agreement is limited to the given definition. “You”, “Bidder”, “Your”, “Buyer”, and “User”: These terms refer to you. “RRA”, “We”, “Us”, “the Company” and “Our”: These terms all refer to Red Rock Auction LLC. “Seller “means the person or entity that placed the item for auction. Each auction listing will include the “Terms of Sale”, it is the bidder’s responsibility to read and understand all requirements and provisions. Any additional terms or conditions listed for a specific auction are in addition to these terms and, in the event of an inconsistency, will supersede these Terms and Conditions. Each specific auction will list the closing date and time. By bidding on an item, you agree to all terms and conditions.
CONDITION OF ITEMS AND WARRANTY: You are bidding on the items as described, not necessarily the item in the photo. RRA Auctions makes every effort to ensure that the descriptions are accurate and the photos match the descriptions. However, an error may occur in the listing and in that case the description takes precedence. If you feel there is a discrepancy or error between a description and the photo, please contact RRA for clarification and to notify us of the error. All items are sold AS IS, WHERE IS, WITH NO WARRANTEY EXPRESSED OR IMPLIED. Descriptions are intended to be accurate but not guaranteed. RRA will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. When not certain of the condition or use of an item, please bid accordingly. If you have any questions, please contact RRA for assistance.
FINAL SALES, ALL SALES ARE FINAL: ALL SALES ARE FINAL! We are not responsible if you bid on the wrong item or decide an item is not suited for your intended use. Once bidding ends, the item is contractually sold to the highest bidder and that item is the buyers property. When in doubt about condition, completeness or suitability for intended use, please bid accordingly.
CHANGES OR ALTERATIONS: RRA reserves the right to add, remove or re-catalog items from an auction, split or combine lots, add minimum bids or post reserve prices, cancel, suspend, extend, or reschedule an item or auction event. RRA reserves the right to make changes to the auction closing date and time, or removal time if necessary.
TRANSFER OF OWNERSHIP: Once the auction has ended, and the items are paid for, the items become the property of the winning bidder (buyer). You assume all risks of loss and damage to property from that time forward, with the exception of insured-shipped property, at that time, loss or damage becomes the responsibility of the shipper and insurance company. PAYMENT DATES AND TIMES ARE ABSOLUTE IF YOU CAN NOT PAY FOR THE ITEMS AT THE END OF THE AUCTION, PLEASE DO NOT BID!
ABANDONMENT & FEES: Failure to pay for the purchased items during allotted time, will result in items being considered abandoned. Ownership of the item will then revert to the party with primary vested interest in the item to sell or dispose of the item as they see fit. Any funds paid shall be forfeited to satisfy terms of sale. You agree to pay all deficiencies, legal, collection and other fees including transportation and storage expenses associated with delinquent accounts or abandoned/forfeited items. Premiums and fees remain applicable. You agree to pay any and all charges and expenses incurred by reason of any breach of the terms and conditions of this sale, including, without limitations, reasonable attorneys’ fees and reasonable attorneys’ fees on appeal.
LIMITED LIABILITY: You acknowledge and understand that the internet system may or may not function correctly the day of the auction or during the auction. Under no circumstances shall you have any claim against RRA if the internet service fails to work correctly before or during the auction. RRA will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxibid maximum bid feature and leave their maximum bid 24 hours prior to the end of the auction. The liability of RRA and the seller is limited to the refund of the purchase price.
CIRCUMVENTION: You acknowledge and agree that you shall not circumvent or attempt to circumvent this auction process, engage in collusion, or otherwise interfere with, interrupt or attempt to interrupt the auction or the operations of the site (collectively, a “Circumvention Act”). Collusion is any agreement between bidders related to the bidding process. If RRA determines, in its sole discretion, that you have engaged, or attempted to engage, in any Circumvention Act, use prohibited automated technology or otherwise unfairly alter your chances of winning an auction, or to otherwise commit fraud with regard to the site. RRA reserves the right to institute civil or criminal proceedings against you and to the relevant authorities.
GOVERNING LAW AND JURISDICTION: This Agreement is entered into in the state of Nevada and is governed by the laws of the state of Nevada and by the federal law, (U.S. Code) of the United States, without reference to conflict of laws principles. You agree to the exclusive jurisdiction of the state of Nevada to adjudicate any dispute arising out of or relating to this Agreement or your use of this site.
