SPECIAL TERMS AND CONDITIONS. If you have purchased a modern gun, make sure you have your FFL Dealer mail or fax a copy of their license to Simmons & Company Auctioneers, Inc. The Auction Company must also have a color copy of the buyer’s driver’s license (for photo ID as well as your social security number), FAX this information to 858-712-1113. All Post 1898 firearms are registerable and must be registered for compliance with both Missouri and Federal Laws. Buyers of Post 1898 firearms must complete all necessary registration forms, whether on the Internet or on-site that are required by their state of residence. Simmons and Company must have in their possession before sale is considered final and completed a signed copy of the dealer’s (or buyers) Federal Firearms License and a color photo ID and buyers SS #. Shipping for Out of State Buyers must be arranged through the Auction Company and must be shipped to a valid holder of a Federal Firearms License on all modern weapons. Cost of shipping and packing will be at the expense of the buyer. No Guarantee as to the operation or firing condition of any weapon offered for sale is made by the Auctioneer or The Auction Company. It is recommended that all weapons bought at auction be checked out by a competent gunsmith prior to attempting to fire them. We will not ship firearms to California, New York or Florida. If FFL documentation is not received, then gun or guns shall be resold and proceeds from that prior sale will be refunded minus auctioneers 20% commission and handling expenses. All property is sold “AS IS”, and ALL SALES ARE FINAL. SHIPPING: Remember SOME ITEMS are heavy and/or BULKY and shipping charges will be based on weight and size of box, as well as destination. Shipping charges will also include the cost of boxes or crates, packing material and labor involved. To insure safe delivery, double boxing (and crating) is often required. Buyers should expect a minimum of four weeks before items are shipped, though every effort to complete that sooner will be taken. Overseas buyers, be advised and understand that it may be upwards of six weeks for you to receive your items. Keep this in mind when bidding. New regulations for USPS (and other carriers) are now in place, and Customs delays can be expected. Any insurance claims will be between the buyer and USPS or other shipper, the auction company is not responsible for lost or damaged items, but will assist you as much as possible in resolving any issues with carrier. Neither our shipper, Doug Roach or the Auction Company has any control over USPS (or other carriers) policies, shipping standards or timeliness of delivery, or their cooperation in handling any claims. If your item is damaged during shipment, you must have the driver or delivery person note that the box is damaged, save the boxes and all packing material, and the specific item(s), and personally contact the local UPS or Fed Ex, or USPS office and file a claim. They are then to send out an inspector. You will need the tracking numbers, etc from each box. The buyer is responsible to pay for shipping immediately upon receipt of invoice, regardless of when the shipment arrives or any problems that are encountered from delays, damage etc. Remember, if you need a different carrier than UPS, such as Fed Ex, USPS please let us know. The Auction Company, Auctioneers, staff and owners are not responsible in any manner for personal injury, accident, theft, loss of personal property or for items purchased or offered for sale during the Auction or during shipment.
