Terms & Conditions All items are sold AS IS, WHERE IS, NO WARRANTY TNT Auction reserves the right to refuse service to any person or entity. Buyers Fee: 16% A 3% cash discount and 2% debit card discount is available for buyers choosing to pay with those methods. (Debit cards must be presented in person and you must use your PIN.) Payment can be made by CASH, CASHIERS CHECKS, CREDIT CARDS, DEBIT CARDS, TRAVELERS CHECKS, & MONEY ORDERS. WE DO NOT ACCEPT PERSONAL, COMPANY, OR CREDIT CARD CHECKS! NO EXCEPTIONS!!! A credit card deposit hold is required to bid in this auction. If you are on our auto-accept bidder list, you will be automatically approved for the auction you are registering to bid. If you are a ProxiBid auto-accept customer you will also be automatically approved for the auction you are registering to bid. Otherwise you will need to make a deposit guarantee with a valid credit card. Bidders are required to submit a deposit guarantee of $200.00. If you make a purchase and have not made other prior arrangements, your credit card will automatically be charged and credited to your invoice. All credit card payments are subject to a 3% convenience fee on the amount charged to your card. All deposits credited to your invoice are non refundable. Failure to remit payment for a balance in the specified time frame will result in the Bidders banishment from any future auctions and may also result in legal action by the Seller and/or Auctioneer. See Buyer Fee terms for cash discount information. Sales Tax (8.5%) will be charged on all lots. Invoices and all Related Paperwork will read exactly how you register. We WILL NOT change any names or addresses once you have registered. NO EXCEPTIONS! Removal: All items must be removed from the sale location within two days following the close of the auction. A storage fee of up to $25 per unit per day plus a $50 yard fee and any transportation fees will be charged on all units not removed by the specified removal date. Additional fees will apply to have the auction facility opened for removal past the removal date. Units may be disposed of and/or resold at the discretion of the Auctioneer to recoup fees. Merchandise becomes the full responsibility of Buyer at time of purchase and Buyer assumes all risk of loss and damage to property until removed from sale premises. DISPUTES BETWEEN BIDDERS: The Auctioneer shall designate the Purchaser after each item of merchandise is auctioned. If a dispute arises between two or more bidders, the Auctioneer reserves the right to reopen bidding. His designation of the Buyer shall be final. DEFAULT / RESALE: a. In the event the Buyer shall default in the performance of the conditions accepted by him under this agreement, then and in the event, said Buyer shall make payment of all costs and expenses, including reasonable attorney fees incurred by the Auctioneer in enforcing the terms of this agreement or pursuing any other remedy available under the laws of the state in which the Auction is conducted. b. Auctioneer reserves the right to resell any property not paid for in full on sale day. The Buyer shall be responsible to Auctioneer for any expenses for resale and collection costs and any damages or shortages resulting from the resale. INJURY AND DAMAGE. Bidder acknowledges responsibility for any personal injury or property damage caused by Bidder or his agent, and further agrees to hold Auctioneer harmless for any personal injury to himself or his agents and any property damage incurred on sale premises. Firearms sold in the auction are being transferred through Precision Arms, a Federal Firearms Licensee (FFL). If you purchase a firearm and want to pick it up in person you can contact them at 760-489-1212 or by email at precisionarmsj@aol.com after the item is paid in full to the auction company. They are located at 250 W Crest St Suite C, Escondido, CA 92025. Additional fees apply for firearm purchases and they are to be paid directly to the FFL. Buyer will be responsible to pay an additional $50 transfer fee per firearm plus shipping charges. An additional $25 background (DROS) fee may also be charged. The FFL will handle any shipping at the buyer’s expense. If you need the firearm shipped to you it must be shipped to another FFL of your choice. The buyer is responsible to have the receiving FFL contact the selling FFL and for all fees charged by both FFLs. All buyers, including FFLs, must pay the transfer fee and any shipping fees to the FFL. California buyers have a mandatory 10 day waiting period. Other states may have a waiting period that must be adhered to from your local FFL. California buyers must possess a Firearms Safety Certificate (FSC). The FSC can be obtained through the FFL for $25 and by passing a test. Firearms can’t be transferred to California buyers who do not have the FSC. Firearms will not be sold to anyone outside of the United States. No international buyers. No high capacity magazines will be given to or shipped to buyers living in states that do not allow high capacity magazines. If the lot includes a high capacity magazine it will not be given to the buyer from the affected states. The buyer will need to purchase their own magazine for the firearm. By bidding on firearms you represent that you are not a minor, convicted felon, drug addict, illegal alien, mentally defective individual, or other person who would be restricted from buying modern firearms, and that such purchase is legal in your home area. A federal background check will be done on all buyers. There will be no refunds if you do not pass the background check. FFL Licensees are welcome to bid and buy. You will need a signed copy of your FFL in order to receive the firearm. Additional shipping and handling fees will be charged to FFL buyers if you need the items shipped to you. Note: California residents can only receive one handgun every 30 days. If you are a California resident and you purchase more than one handgun, storage fees will apply at the rate of $1 per day per handgun. The FFL only accepts credit cards in person and can’t accept them over the phone. Payments to the FFL must be in person or by personal or certified check. The FFL will charge storage fees if you have not made arrangements to receive your purchases after 30 days. GOVERNING LAW: This Auction shall be conducted subject to California Law. Any laws that apply, both Federal and State will be subject to California Jurisdiction. Despite our efforts to avoid withdrawal of items from the auction after they have been advertised, it may become necessary to do so; therefore, the Owner and/or Auctioneer reserves the right to withdraw units at any time. Auctioneer cannot, and will not, be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that they are taking part in the auction electronically and the nature of the auction relies on hardware and software that may malfunction without warning. The Auctioneer, in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any unit(s) that may have been affected by any malfunction. This decision of the Auctioneer is final.
