Auction Gallery LLC may retain all funds received as deposits as liquidated damages. Lots not paid for or removed within the time allowed may be resold at public or private sale without further notice. Any deficiencies and other expenses of resale will be charged to the defaulting purchaser. The equipment must be removed by authorized riggers and contractors only. Please check all photos, as they are part of the description as well. We endeavor to photograph all damage and problems, and expect the buyer to inspect all photos. Please note, some lots are times the money, and will say so when you bid. If you have placed a bid, there is no way for us to edit that after the fact, so the software was set up and you agreed to bid "times" the bid price when you initially bid. In the event an item is lost, stolen, or misplaced, you will be reimbursed for that item at the price paid or a prorated amount. If an item lists that there are 10 items and there are only 9, you will be reimbursed at the prorated amount of those nine items. We will not reimburse for items that never existed at any rate other than what you paid. Binding Arbitration: The parties agree to use their best efforts to amicably resolve any dispute arising from or relating to this Agreement. Any controversy, claim, or dispute that cannot be resolved shall be settled by final, binding arbitration per the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator or arbitrators may be entered in any court having jurisdiction thereof. Any such arbitration shall be conducted in Licking County, Ohio, unless otherwise mutually agreed upon by the parties. Within fifteen (15) days after the commencement of the arbitration, each party shall select one person to act as arbitrator, and the two arbitrators so selected shall select a third arbitrator within ten (10) days of their appointment. Each party shall bear its own costs and expenses and an equal share of the third arbitrator’s expenses and the administrative fees of arbitration.
