ONLINE REAL ESTATE TERMS & CONDITIONS
A 6% Buyer’s Premium will be added to the final bid price and included in the total purchase contract price(s) for online buyers.
Disclaimer Chuck Yarbro Auctioneers & Real Estate Services, LLC hereafter the agent, is providing live Internet bidding as a service to the Bidder. Bidder acknowledges and understands that this service may or may not function correctly day of auction. Under no circumstances shall the Bidder have any kind of claim against agent or anyone else if the Internet service fails for any reason before or during auction. Agent will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins.
Procedure: Parcels 1 and 2 will be offered as individual parcels and/or as a total unit. There will be open bidding on both individual parcels and both parcels as a whole during the auction, as determined by the auctioneer. Bids on individual parcels and the property as a whole may compete. Property will be sold in the manner resulting in the highest total sale price, subject to the seller’s acceptance or rejection.

Procedures for Successful bidder(s):
Earnest Money Cashier’s check will be handed over to Stewart Security Title & Escrow for deposit in their trust account.
Buy Sell Agreement: Said agreement will be emailed or fax to successful bidder day at conclusion of auction. Buyer(s) will sign, return by fax or scan and email to chuckjr@yarbro.com
Financing: Please view the list of potential banking institutions who have expressed interest in exploring the possibility of financing this property.
Approval of Bid Prices: All successful bidders will be required to enter into Purchase and Sale Agreements at the auction site immediately following the close of the auction. The auction bids are subject to the acceptance or rejection by the Seller.
Deed: Seller will provide Warranty Deed(s).
Evidence of title: The Seller agrees to furnish, at Seller’s expense, an Owner’s Policy of Title Insurance in the amount of the purchase price.

Closing: Closing will be on or before Monday, October 31, 2011, or as soon there after as applicable closing documents are completed by Seller. If needed, Stewart Security Title will close electronically or with a branch new purchaser.
Acreage & Tracts: All acreages are approximate and have been estimated based on current legal description, county assessor records, and/or aerial photos. Any corrections, additions, or deletions will be made known prior to the auction.
Survey: There are no current surveys on either of the two parcels offered for sale. Any need for a new survey shall be determined solely by Seller. In that event shall each pay half (50%:50%) of the cost of the survey. The type of survey performed shall be at Seller’s option.
Possession: At closing.
Closing Costs: 2011 real estate taxes will be prorated at the time of closing. Seller to pay title insurance. Balance of closing costs will be shared equally (50%:50%) by Buyer & Seller.
Failure to Close: If, for any reason the Buyer fails to close, the earnest money shall be retained by the seller and the broker per the terms of the Purchase and Sale Agreement.
Note: Announcements made sale day by auctioneer or auction floor staff take precedence over previously printed matter or any other oral statements. The property is to be sold “As is, where is”. Conduct of the auction, increments of the bidding and decision as to high bidder will be at the direction and sole discretion of the Auctioneer.
