If the Buyer can not make payment arrangements by due date they must contact our office before 5:00PM or the auction company will consider the buyer to be late on payment. The Buyer is fully responsible for the item(s) at the drop of the hammer regardless if payment has /or has not been made. Buyer is fully responsible for any extra fees that may apply by not following the terms he/or she agreed too. 4) Removal of Equipment: Union Pacific will move locomotives with alignment control couplers on our line free of charge within 30 days after sale. Special moves required for locomotives with non-alignment control will be paid for buy the buyer. If the final destination is on a foreign carrier the free move will be to the nearest interchange point. All moves are at Union Pacific discretion. 5) Bidders are to be held personally liable for any bids made with their Bidding Number. 6) The highest bidder for each Lot shall be the Purchaser, and in the event of any dispute the Auctioneers shall have absolute discretion either to settle such dispute or to re-offer the lot for re-sale. 7) The Auctioneer accepts no liability for loss or damage howsoever arising (including but not limited to costs of attendance of Bidders at the Auction) from any Lots not presented for sale. 8) The Auctioneer has described the Lot(s) in the catalog to the best of their ability and belief from information furnished by the Vendor(s) who shall be alone responsible for any error or miss-statement, which there may be. The Auctioneer undertakes no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact 9) All items are sold AS IS, WHERE IS, with all faults. The Auctioneer provides no guarantees or warranties (express or implied) in respect of the Equipment contained in the Lot. All representations made by the Auctioneer its servants or agents are to be considered lay opinions only and the Auctioneer accepts no liability for any purchase made by a Buyer in reliance upon them. 10) The Buyer agrees to insure the Equipment purchased against all losses from the Auction Date until removal of the Equipment by the Buyer. 11) The Buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth. We accept personal and company checks only with a guaranteed letter of credit from your bank. Please fax that letter to 501-664-4538 and present the original when registering at the auction. We accept cash. We do not accept credit cards. If you are using a finance/leasing company to pay, contact us prior to the auction and inform us of the payment policy. If you would like to wire transfer funds, please call for pre approval. Applicable Arkansas Sales Tax Laws apply. You will be charged the tax unless you can provide us with a copy of a resale exemption form. Exporters must pay the tax on sale day, provide us with the proper paperwork within 30 days and we’ll refund those taxes. If you do not bank in the U.S. and/or cannot provide a sufficient letter of credit you will need prior Blackmon Approval to bid or a $25,000 minimum deposit or 25% deposit of expected purchases (whichever is greater).
