SHIPPING COSTS: For items that can be shipped in USPS flat rate boxes, the auction company will pack and mail merchandise at buyer's expense plus an additional $5 handling charge. The handling charge, actual shipping cost and any extra insurance needed will be charged to the buyer and billed on a second invoice. Your card will be charged this amount prior to shipping. For items that cannot be shipped this way, special arrangements need to be made with an outside shipper at buyer’s expense. By bidding on any item, the bidder shows acceptance of the terms of the auction. The auction company reserves the right to refuse service to any person. All announcements made day of auction take precedence over any and all written or verbal statements. The Auction Company will attempt to describe the merchandise in advertising to the best of their ability, but in no event shall the Auction Company be held responsible for marketability, expressed opinion of value, or fitness for a particular purpose. Bidder shall be the sole judge of value and is solely responsible to determine value for their intended purpose. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. Further Terms for all Auctions: The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company arising from debt collection. The purchaser also agrees that a fee of 4% per month be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser’s failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Noble County, Indiana. The auctioneer has the sole discretion to advance the bidding and may reject a nominal advance, should it in his estimation prove injurious to the auction. The auctioneer shall be the final judge in all bidding disputes and shall name a bidder as the purchaser. IF THERE IS AN INTERNET OR SOFTWARE FAILURE during online bidding, the auction will continue as normal and the item will be sold to the bidder (live or online) with the highest bid at the point at which the hammer falls. In case of broad reaching internet or software failure, bidding times may be suspended or extended at the Auctioneer’s discretion. The auction company shall not be held responsible for any bids unseen by the auctioneer or any bids deemed late by the online software.
