TERMS AND CONDITIONS This is a legal agreement between you, the user or buyer, and South Texas Auction Company LLC. You should read this agreement carefully before accepting its terms. When you click on the Online Form to become a bidder, you will be redirected to Proxibid.com, and you must agree to the Proxibid Unified User Agreement. You are bound by the obligations of that agreement. In addition, by submitting the Online Form, you agree to these Terms and Conditions. DO NOT BID IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS OR YOU ARE UNABLE TO PAY WITHIN THE SPECIFIED TIME PERIOD. DEFINITIONS The following terms are defined for use in this agreement, and their meaning in this agreement is limited to the given definition. 'You', 'Bidder,' 'Your', 'Buyer', 'User': These terms refer to you, the individual participating in the auction. 'STAC', 'We', 'Us', 'the Company', 'Auction House': These terms refer to South Texas Auction Company LLC. 'Seller': Refers to the original owner of the auction item. SPECIFIC AUCTION TERMS Each auction listing will include a specific "Terms of Sale" in addition to these terms. In the event of a conflict, the specific auction terms will prevail. Each auction will list closing date, inspection details, and removal times. By bidding on an item, you agree to those specific terms. PAYMENT The balance is due at the end of the auction. Once you are declared the winner, your credit card on file will be automatically charged for the total amount, including the winning bid, 22% buyer’s premium, and any applicable sales tax. A 4% surcharge will apply to all credit card payments. We accept cash, check, ACH (no fees) for payments. Credit cards are accepted for invoices under $3,000 with a 4% processing fee. Wire transfers are accepted with a $20 fee. All payments must be completed within 72 hours of auction close. If you elect to pay by cash, check, or ACH, please notify STAC before the auction closes. NONPAYMENT CONSEQUENCES Failure to complete payment within 72 hours of auction close will result in reporting to Proxibid, and you will be ineligible for future auctions. In the event of nonpayment, STAC reserves the right to: - Retain ownership of the item. - Charge any costs of storage or resale of the item. - Resell the item and hold you responsible for any shortfall, fees, or damages. BUYER’S PREMIUM AND SALES TAX A 22% buyer’s premium will be applied to all purchases. No sales tax will be charged except for Texas residents, where applicable state sales tax will be added. NO SALES TAX REFUNDS WILL BE PROVIDED. If you are tax-exempt, you must email your tax-exempt form to info@southtexasauction.com prior to the auction closing. LOCAL PICKUP AND SHIPPING There are no local pickups. All items will be shipped to the buyer's chosen FFL dealer for firearm items or their home address if the item is not subject to FFL regulations. Buyers must provide the receiving FFL information within 7 days of auction close. Failure to do so within 10 days will result in the items being considered abandoned, with no reimbursement. Buyers are responsible for all shipping costs. SHIPPING COSTS - Rifles: $20 each - Pistols: $15 each - Ammunition Lots: $15 for the first lot, $5 for each additional lot COMPLIANCE WITH ATF REQUIREMENTS AND BACKGROUND CHECKS STAC complies with all ATF regulations for firearm sales. All firearm sales will require a background check. Firearms will only be shipped to licensed FFL dealers, and the buyer is responsible for ensuring compliance with local, state, and federal laws. No refunds will be issued for failed background checks. Buyers from certain states (New York, Connecticut, Illinois, Massachusetts, New Jersey) must provide an FFL or FOID for ammunition shipments. WARRANTY & CONDITIONS OF ITEMS SOLD All items are sold AS IS, WHERE IS, with NO WARRANTY expressed or implied. Descriptions are believed to be accurate but are not guaranteed. It is the bidder's responsibility to inspect the items and verify all details prior to bidding. No refunds or returns will be accepted after the sale. FINAL SALE ALL SALES ARE FINAL. Once the auction ends and the item is sold to the highest bidder, the item becomes the property of the buyer. No refunds or exchanges will be offered under any circumstances. Buyers are responsible for verifying the condition and suitability of the items before bidding. CHANGES STAC reserves the right to make changes to auction lots, re-catalog items, and modify auction closing or inspection times. These changes will be reflected in the specific auction terms. REMOVAL OF PURCHASED ITEMS All purchased items must be shipped to the buyer's chosen FFL or address. Removal times will be listed in the auction details. Failure to arrange shipment within the specified time will result in abandonment of the items, and ownership will revert to STAC or the seller. The buyer will forfeit any payments made. LIMITED LIABILITY STAC is not responsible for missed bids or internet failures. We recommend using the proxy-bidding feature to ensure your bid is acknowledged. Our liability is limited to the refund of the purchase price in the event of errors or disputes. GOVERNING LAW AND JURISDICTION This agreement is governed by the laws of the State of Texas and the federal laws of the United States. You agree to the exclusive jurisdiction of Texas courts for any disputes related to this agreement or auction participation. RIGHT OF REFUSE BIDDING PRIVILEGES South Texas Auction Company LLC reserves the right to refuse bidding privileges to any individual at our sole discretion, including but not limited to individuals with a history of nonpayment, chargebacks, or behavior deemed disruptive or detrimental to the auction process.
