Payment
After the Live Virtual Auction, winning bidders will receive an ATGPay-compatible invoice via email. To pay, click the blue button at the top right of your invoice. For amounts over $5,000, an ACH payment (Digital Check) is required via ATG Pay. Bidders have 72 hours to complete payment before outstanding invoices are automatically charged to the card on file with ATGPay. Sales tax is calculated by ATGPay based on your address. Buyers seeking tax exemption should register as such with Proxibid prior to bidding. If your are tax exempt, and see sales tax on your invoince, please reach out to payments@proxibib.com. Terms Of Sale
Our goal at Evan Gallo Auctioneers LLC is to have satisfied buyers and sellers! To help us reach that goal please make yourself familiar with our Terms and Conditions for the Virtual Live Auction.
1. Registration : Each Online Bidder is required to register for each auction and must be approved by Proxibid as well as Evan Gallo Auctioneers LLC in order to place bids on the auction. Each registration request will be reviewed promptly and accepted or denied. Bidders with a recorded history of non-payment will be denied, while most others will be accepted and we welcome you! Evan Gallo Auctioneers LLC reserves the right to deny bidder registration for any and all reasons.
2: Buyers Premium : A 15% Buyers Premium will be added to each purchase. If you bid $100.00 you will be charged $115.00 upon invoicing at the auction closing.
3. Sales Tax : Sales tax will be automatically calculated by ATGPay upon receiving and paying for invoice. The local sales tax will be determined by the address of the buyer. All tax exempt buyers must be registered as such with Proxibid prior to the auction closing.
4. Payment : Upon the close of the Auction Event, winning bidders will receive an emailed invoice that supports ATGPay. Each winning bidder will be able to pay their invoice in a 72 hour period following the close of the auction. After the 72 hour period, all outstanding invoices will be charged to the card that is on file with ATGPay. All invoices totaling over $5,000 will be required to pay using ATGPay ACH Transaction (Digital Check). All payments will be processed using ATGPay. Buyers are responsible for any credit card transaction fees.
5. Removal and Shipping : All items in this auction will be shipped unless other arrangements are made between the Buyer and Auction Company. Shipping invoices will be sent to buyers after the winning bidder's auction invoice is settled. Although not required Evan Gallo Auctioneers suggests shipping insurance on all packages for the total value of the items being shipped. Buyers are responsible to contact Evan Gallo Auctioneers for the purchase of Shipping Insurance. Winning Bidders will have 3 weeks to pay for their shipping invoice, any that fail to pay their invoice surrender the items that are to be shipped and their shall be no refund granted to the winning bidder. To avoid this dilemma, if you have any questions in regards to shipping please contact Evan Gallo Auctioneers.
6. Bidding Errors : We will no reverse bids that have caused another bidder to be outbid. You should immediately review your bids prior to submitting them to avoid inaccurate bids and/or bidding on the incorrect item. We will not reverse bids after the auction has begun to close. No Exceptions.
7. Customer Commitment : At Evan Gallo Auctioneers LLC, we made it our goal to have both satisfied buyers and sellers, to ensure that we achieve that, bidders must be compliant with our Terms and Conditions. We at EGA have very carefully cataloged our auctions and provided descriptions that we believe to be correct; in addition added high quality photos that assist the buyers in making their purchase. It is the sole responsibility of the buyer to determine age and authenticity of items listed in the auction. If you have any questions, concerns, or request additional information/photos please reach out to Evan Gallo Auctioneers to make sure that you have all of the information that you need to ensure your satisfaction in your purchase.
8. Bidding Procedure : If you are bidding and immediately outbid, it is likely that you are bidding against a maximum bid that was placed on the item. Many buyers use maximum bids to because they are proven to be effective and ensure they don't get "left behind" if they forget about the auction. For those new to online auctions, we suggest using maximum bid features to securely place your bid and allow the software to bid on your behalf as the auction closes.If you mistakenly increase your own bid, place your bidder number in the bid field, or make a gross error you must immediately contact our office at 330-314-0613 or at Evan@EvanGalloAuctionees.com. Communication of the error does not in itself resolve the error, Evan Gallo Auctioneers LLC will attempt to address the bidding error.
9. Auction Closing : Winning Bidders will be contacted by Email. (You are responsible for checking your email). If you feel you have won an item and have not received an email you must notify us by email within 12 hour of the auction closing. If you do not receive a paid email invoice, then you did not win any items at the online auction. NOTE: it takes time to process invoices so plan on up to 2 hours after auction close to receive your invoice.
10. Auction Description : Evan Gallo Auctioneers LLC has carefully listed each item in the Virtual-Live Auction. We have also supplied our buyers with high quality photos that assist buyers in making an informed purchase. We believe our descriptions of the items to be correct, However, it is the sole responsibility of the buyer to determine age and authenticity. We encourage all of our respected patrons to contact us if you have any questions or concerns in regards to a lot(s) in the auction you may be interested in. Items that we believe to be modern have been labeled as such or "Folk Art", this do not guarantee items that are not listed as such. If you personally have suspicion of a piece, bid accordingly.
11. Warranty and Condition of Items Sold : All items are sold "As-Is, Where-Is" with no warranty expressed and implied. Descriptions are believed to be accurate but not guaranteed. When not certain of condition or authenticity, bid accordingly. We have selected and described items to the best of our ability and are proud of the selection of items that we have provided our valued bidders. We encourage all bidders to contact us with any questions or concerns in regards to the items listed for sale prior to the closing of the auction. We will be happy to assist you in providing information and additional photos.
12. Reserve Auction All Evan Gallo Auctioneers LLC "Online Auctions" are "With Reserve".Therefore, the auction company reserves the right to establish or change bidding increments, remove items from the auction, split or combine lots, add minimum bids or reserve prices, cancel, suspend, extend or reschedule an individual item and or auction event. Suspend or cancel the bidding of any buyer at any time. Change, modify, delete or add to descriptions, photos. Change auction closing time, inspection or removal times. Rescind the sale of any or all items regardless of high bid upon auction conclusion. Evan Gallo Auctioneers LLC permits the registration and bidding of any party as long as they meet the registration requirements and terms and condition including sellers, members, owners, employees and associates of Evan Gallo Auctioneers LLC. The auction company is not responsible for technical or communication problems, website outages, browser incompatibility or any connectivity issues.
13. Liability : Auctioneers and Sellers liability shall be limited to the refund of bidders purchase price.
14. Privacy : Evan Gallo Auctioneers LLC will not sell bidders information. Bidders who register consent to be contacted or emailed auction notifications for all Evan Gallo Auctioneers LLC. To be removed from our database, reply with "remove" in the subject line of the email. You do not need to subscribe to our email list if you are a registered bidder. If you wish to re- subscribe, simply enter your email into the "subscribe email field" at our website.
15. Limitations : The above-stated terms and conditions of sale cannot be altered except in writing by the auction company. Terms and conditions may change from auction to auction and are agreed to electronically by bidders upon registration. Terms and conditions are designed as general guidelines and may not cover every possible scenario. Evan Gallo Auctioneers LLC. is not responsible for the fraudulent or unauthorized use of your bidder number and bidding account. Bidders are responsible for the security of same. If you feel someone may possess this information, it is suggested that you change your password immediately. Buyers agree that they have reviewed and agree to all terms and conditions of the auction. These terms and conditions constitute an enforceable and binding electronic agreement upon their electronic acceptance by the Bidder.
