ON-LINE TERMS AND CONDITIONS OF THE AUCTION
• In order to participate On-Line in the auction, a $20,000 certified check, payable to “Marianne T. O’Toole, Chapter 7 Trustee”, must be received by the auction company by 5pm on Wednesday, October 26th. NO EXCEPTIONS!
• On-Line bidders identification will be required in the form of a Driver’s License or other form acceptable to the Trustee. The contract will be under the same name as indicated in the registration, unless pre-approved by the Trustee.
• On-Line Bidders will submit an executed ‘Terms and Conditions of Sale’ as prepared by the Trustee with any deposit to be considered an eligible bidder.
• In the event that you are not the Highest Bidder or the Second Highest Bidder, your certified check will be returned within 4 days following the auction.
• The Second Highest Bidder’s deposit will be returned upon receipt of the Highest Bidder’s entire 10% deposit (within 5 days of the auction).
• A total of a 10% deposit in the form of a cashiers check, payable to “Marianne T. O’Toole, Chapter 7 Trustee”, is due by the first business day following the auction with an executed ‘Memorandum of Sale’.
• If you are the High Bidder, you will receive an email with a ‘Memorandum of Sale’ that needs to be signed and emailed back on the day of the auction by 5pm, with the original overnighted to the Auction Company, with any additional deposit to be received by 5pm the day following the auction. If the high bidder’s original ‘Memorandum of Sale’ and additional deposit are not received by 5pm on the day following the auction, they will be declared in default and the deposit on hand will be forfeited to the Trustee as liquidated damages.
• In the event that the Highest Bidder defaults on their contract, the Second Highest Bidder will be notified of the default and they will then have until the end of the next business day to submit their original ‘Memorandum of Sale’ and any additional deposit.
• There is a 1% Buyers Premium for on-line bidders. (This is paid directly to Proxibid as their on-line hosting fee.)
• Closing is within 21 days or by November 16, 2017, time being of the essence.
• NO Contingencies, for financing, inspections or anything else..
