UPON REGISTRATION FOR YOUR BIDDING NUMBER YOU HAVE ACKNOWLEDGED AND ACCEPTED THE TERMS AND CONDITIONS LISTED ON THE SHEET TITLED “TERMS AND CONDITIONS OF AUCTION SALE”, YOUR BIDDER CARD, THOSE EXPLAINED IN THE CATALOG COVER SHEET, THOSE POSTED IN THE SALE SITE, AS WELL AS ANY EXPRESSED AT THE START OF THE AUCTION. BIDDING AT AUCTION IS A LEGAL CONTRACT BETWEEN THE BIDDER AND THE AUCTION COMPANY AND IS THEREFORE BINDING ON BOTH PARTIES.
PLEASE NOTE: We must report, on IRS form #8300, any transaction that includes a cash payment exceeding $10,000. This includes any combination of cash, and /or cash equivalents(Travelers check, Money Order, Cashiers Check, etc).
1.All items & lots are sold in AS IS condition, whether specified or not.
2.All bidders & buyers are solely responsible for examining and inspecting any and all items they are bidding on and for determining the condition, description and value of those items.
3.O.P.M. AUCTIONS Staff ARE NOT responsible for errors on description in regards to condition, age, authenticity or provenance of any items whether given orally or as typed in the catalog or invoice.
4.The records of our bookkeepers shall be all conclusive as to the amount of the final bid.
5.No refunds. No returns. All sales final
6.All bills must be paid IN FULL by end of auction. If not paid in full you may forfeit your deposit.
7.All purchases must be removed from the auction site within 24 hours of the conclusion of auction. Large pieces of furniture will be held for pick-up for 3 days. After that time items will be disposed of and buyer will forfeit their right of ownership, forfeit their payment and/or any deposit. In the event special arrangements have been made with the Auction House for later pick-up a $25.00/day/item fee will be charged for storage and handling. In no event will an item remain longer than 10 calendar days. After 10 days the item will be disposed of by the Auction Company. No items will be picked up until after the auction has ended.
8.The packing, handling, shipping & trucking of purchased items is at the sole risk and expense of the purchaser.
9.Persons attending the exhibition, auction or are packing or removing purchases from auction site assume all risk of injury and /or damage and specifically release O.P.M. AUCTIONS LTD., staff members and auctioneer from any and all liability thereof.
10.In the event of a dispute we reserve the right to re-offer an item. We reserve the right to withdraw any item from the auction at any time.
11.Your initial cash deposit will be refunded only if no purchases are made. Your initial deposit will be applied to your bill if purchases are made. No Exceptions.
12.Payments are to be made in cash or credit card only. All On-Site auction sales are cash only sales.
13.A standard 10% buyers premium is applied to all successful bids. A buyer’s premium of 15% will be applied to all purchases made online through PROXIBID and our Company. Sales tax of 8.625 collected on all bill totals. Only exception will be for buyers with a valid resale certificate from NEW YORK STATE related only to resale of the auction merchandise sold. A properly filled out NYS Resale form must be filed.
14.All absentee bids will be accompanied by a 50% deposit of the bid unless waived by the Auctioneer.
15.No credit card charges will be accepted for single item purchases unless approved by the auctioneer. Absentee buyer’s whether by phone bid or left bid will pay by good check only and no credit cards. All absentee buyers out of the continental United States will pay for purchases with a wire transfer.
16. Any additional Terms and Conditions of Sale will be announced at the start of the auction.
