If You Are a Texas Resident Sales tax will be charged unless the buyer has a dealer's resale certificate that is directly related to the industry that is being sold. Prospective buyer should present their resale information at the time of registration. FIREARMS: All Applicable Federal, State, & Local Firearms Regulations Apply To All Firearms Sold. All buyers of modern firearms must pass the federally required background check. No modern firearms will be sold outside the continental United States. No foreign bidders on modern firearms. No gun sales to California or New Jersey. No sales of semi-auto assault type rifles to the following states: California, New Jersey, Massachusetts, New York, Hawaii, and Connecticut. All sales of modern (post 1898) weapons must be shipped to a Federal Firearms Dealer of your choice, in your area. All items not picked up in person by Texas residents must be shipped to a licensed FFL dealer in your state. If You are the winning bidder on a modern firearm and the firearm cannot be shipped to you, or if you cannot pass the background check, you are still responsible for the FULL purchase price of the firearm. And The firearm will be resold at buyers expense. Burley Auction Group assumes no responsibility for injuries or damages from inherently dangerous items sold, such as firearms, motor vehicles, etc.. All items should be professionally inspected prior to use to ensure the safe usage such items. SHIPPING: Burley Auction will provide a list of local shippers that will professionally package & ship items at your request. Shipping is a total separate business transaction. Although we will do whatever we can to facilitate shipping including delivering your item to the shipper, Burley Auction is not responsible for packaging & shipping charges or performance of shipping company. Be Sure To Insure All Shipped Items For Full Purchase Amount. You may use any professional shipper of your choice. A list of local shippers will be provided to winning bidders. WINNING BIDDER: The winning bidder is determined by the auctioneer, when the hammer is dropped & the lot is sold. In the event of a tie bid, in house bids take precedence over all others. We NEVER want to miss a bid but Burley Auction is not responsible for missed online bids, or the performance of Proxibid, or internet service providers. Any deletions or additions to the sale will be announced by the auctioneer either before or during the sale. ALL ITEMS SOLD AS IS WHERE IS, WITH ANY & ALL FAULTS. Bidders should satisfy themselves as to the usefulness and value of each item prior to bidding. Any statement made by the auctioneer or seller regarding the items to be sold should be considered a guide and guide only. Any error in description does not relieve the buyer or his agent of their responsibilities. In the event of a dispute between buyer & seller, the auctioneer will act as the mediator & auctioneers word will be final. Buyers assume all responsibility for removal, transportation and handling of purchases. Removal of items on Sale Day, or By Appointment. Any item not removed within 30 days will be deemed abandoned, (unless storage of items is agreed upon prior, by auction house). Proxibid bidders must pick items up, or arrange & pay for shipping. Burley Auction will gladly assist with finding a local shipper, & will deliver to shipper for you within 30 miles upon request. The buyer hereby assumes and does agree to indemnify and hold harmless the auctioneer and sellers from any current or future claim which shall pertain to the fitness, use, damage, safety, injuries to persons or property that may have occurred during the auction or that may have been caused by or during removal or use of items purchased, or any other claim regarding the use of that asset as purchased. Neither the Auctioneer, Auction Company, nor the Seller assumes responsibility for any accidents or loss due to theft, fire, vandalism, or personal injury. Burley Auction Group Inc.
