Sales tax will automatically be charged to all buyers unless the buyer notifies the auction company immediately upon the purchase of the buyers exempt status. This should be done by emailing oldwest@curtis-ne.com with sales tax exempt information. Farmers who wish to be sales tax exempt on purchases of Farm Equipment to be used in production agriculture, or dealers purchasing any taxable item and wanting exempt status must fill out a Nebraska Form 13 to become exempt. NO EXCEPTIONS.
All purchases must be paid for by wire transfer or credit card within 24 hours of the auction. There will be a $20 title fee charged on any item purchased that has a title. Contact the auction company @ 308-737-7335 for wire transfer details.
A 3% administration fee will be charged on all transactions, fee waived by payment with wire transfer.

All property is sold "AS IS", and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Old West Realty & Auction may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representation. In no event shall Old West Realty & Auction be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value.
Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. Old West Realty & Auction shall endeavor to describe in detail each item and any pertinent information about it. Old West Realty & Auction will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase.
Upon Bidder's successful purchasing of an item through Proxibid, full responsibility for the purchased items is upon the buyer. Full possession will be given upon confirmation of full payment being made by the purchaser.
Old West Realty & Auction is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction.. Under no circumstances shall Bidder have any kind of claim against Old West Realty & Auction or anyone else if the Internet service fails to work correctly before or during the live auction. Old West Realty & Auction will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Old West Realty & Auction reserves the right to withdraw or re-catalog items in this auction.
Hour and mileage readings are not guaranteed to be accurate. It is the bidders responsiblity to make make their own inspections as to the condition, age, and meter reading of all items.
Dealers who wish to be tax exempt must fill out and sign a Nebraska Form 13 and e-mail it to Old West Realty & Auction at oldwest@curtis-ne.com by 4:00 pm the day of the auction.
