On Line Bidding Terms & Conditions All Internet Buyers must provide a Letter of Payment Guarantee from their financial institution. All Letters must be faxed to 1.717.665.0809. The Letter must be as follows: “Mr. (Customer Name) of (Company Name) is a customer in good standing at our bank. We will guarantee the payment of their purchases at the (Auctioneer) located in (City/State) on (Auction Date) up to (specify amount) dollars from (account number). We hereby agree that no stop payment will be issued in conjunction with this letter.” The property up for auction will be offered by Auctioneers as an agent for the seller, governed by the terms and conditions listed below: 1. John M. Hess Auction Service, Inc. (the auction company) has put forth every effort to prepare accurate descriptions of all items for this cataloged auction. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. Though all description and commentary are believed to be correct, neither Auctioneer nor Seller makes any warranties or representations of any kind with respect to the property, and in no event shall be held responsible for having made or implied warranty of description, genuineness, authorship, attribution, provenance, period, culture, source, origin, condition, etc. Property is open to thorough public inspection and it is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. 2. Auctioneer or Seller reserves the right to withdraw any item before or during the sale. 3. The Seller reserves the right to reject any and all bids it deems necessary. 4. ALL SALES ARE FINAL. ALL PROPERTY IS SOLD “AS IS, WHERE IS” and is without warranty. Bidders may not return any item they purchase. 5. John M. Hess Auction Service, Inc. will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid before the auction begins. Auctioneer may reject a nominal or fractional bid advance if, in his estimation, it proves injurious to the sale. 6. The buyer shall be the highest bidder. In case of dispute between two bidders, the Auctioneer shall be the final judge and shall name a bidder as the purchaser. 7. When the Auctioneers says “SOLD”, title of the property shall pass to the highest bidder, who assumes full risk and responsibility. All property shall be removed from the premises by the purchaser at his own risk and expense within the time period announced by the Auctioneer. 8. John M. Hess Auction Service, Inc. is providing internet pre-auction and live bidding as a service to the Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against John M. Hess Auction Service, Inc. or anyone else if the internet service fails to work correctly before or during the live auction. 9. Prior to removal of purchases and within 5 business days of the close of this auction, payment must be made in the form of Cash, Wire Transfer, Cashier’s Check or a Company Check accompanied with a letter of guarantee. 10. Applicable State of PA Sales Tax will be charged on all Lots. Bidders from outside the state of PA will be exempt from Sales Tax if they provide proof of an approved tax exemption status form and exception certificates that are acceptable to the state of PA. 11. Buyer acknowledges that Seller has provided him with the opportunity to inspect the item(s) before purchasing them and the buyer has or has not so inspected the items(s) in his sole discretion. 12. It is the buyer’s responsibility to make arrangements for shipping and trucking for removal of equipment. 13. The buyer acknowledges he/she has read and agrees to be bound by the additional terms and conditions set forth 14. All announcements made the day of the auction take precedence over any and all written or verbal statements.
