Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, authenticity, value or any other determinative factor. Burnt Chimney Auction Gallery shall endeavor to describe in detail each item and any pertinent information about it.
Burnt Chimney Auction Gallery will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase.
Burnt Chimney Auction Gallery is providing Internet pre-auction and live bidding as a service to Bidders. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Burnt Chimney Auction Gallery) or anyone else if the Internet service fails to work correctly before or during the live auction. Burnt Chimney Auction Gallery will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Burnt Chimney Auction Gallery reserves the right to withdraw or re-catalog items in this auction.

Please note these assets are sold one time with non-retractable bids. When you bid on any item, you are entering into a binding contract. If your bid is the winning bid on any item, your credit card will be charged for your purchase. A 15% Buyer’s Premium will be charged in addition for all internet bids..
2. Payment Instructions:

A pre-auction authorization will be performed to establish available credit. NOTHING will be charged to your card until a purchase is made. Credit card chargeback’s will not be accepted. Virginia residents and anyone picking up purchased items in Virginia will be charged 5% sales tax unless a tax exempt number is on file with Burnt Chimney Auctions.
Any bidders with credit cards that are declined on reconciliation day will be charged a $30 processing fee to run another credit card- NO EXCEPTIONS!
3. Shipping procedure and payment
Shipping cost is the sole responsibility of the buyer. Your credit card will be charged twice- once for purchases and once for shipping / handling. Shipping and handling fee will be charged to the credit card on file as soon as the final cost is determined.
We will automatically ship, unless other arrangements are made.
Burnt Chimney Auction Gallery will ship normal sized, non breakable smalls, through the USPS. When items are shipped by Burnt Chimney Auction Gallery, buyer will be charged actual shipping costs plus a $5.00 handling fee.
If Burnt Chimney Auction determines that items need special handling due to fragile nature, unusual shape, weight, size (furniture) or other factor, it will arrange for packaging and shipping through a local packaging company. The bidder will be charged the fee levied by the packaging company for shipping and handling.

4. Shipment of Firearms
There are two categories of firearms. Guns manufactured prior to 1899 are considered antiques and do not require FFL authorization for shipping. Any gun manufactured from 1899 to today is considered modern guns and requires FFL authorization for shipping.
The USPS has strict rules about mailing firearms, so Burnt Chimney Auction Gallery will ship all antique guns through the packaging service. All modern guns must be shipped by overnight service.
All modern hand guns and long rifles must be shipped to a FFL Dealer. All guns must be signed for. Before Burnt Chimney Auction will ship your firearm purchases, we must have on file a copy of the FFL License for the dealer that the guns will be shipped to and we must be able to verify all information for that dealer is valid and verifiable with the ATF. Burnt Chimney Auction Gallery will accept a mailed or faxed copy of the FFL authorization. The address of the auction house is:

Whether faxed or mailed; the FFL must be clearly legible and include your name and auction information. If it is not clearly legible, we cannot ship. If we receive a license with no information on the bidder, we will not be able to match it to your auction and ship. Poor license copies and lack of information as to what auction they are for are the main causes of shipping delays. We will only ship firearms to FFL dealers in the 50 United States.
We will provide the receiving dealer with a copy of our FFL shipped with the gun.
Attention California Residents: We do not ship firearms to California residents.
25% restocking fee
