Terms Of Sale
THE FOLLOWING TERMS AND CONDITIONS OF SALE CONSTITUTE ALL TERMS AND CONDITIONS ON WHICH THE LISTED PROPERTY SHALL BE OFFERED FOR SALE OR SOLD BY MICELI, APPRAISALS & LIQUDATORS, INC. BY BIDDING AT THIS AUCTION YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS AND CONDITIONS OF SALE.
1. AGENCY: Miceli Appraisals & Liquidators, Inc. is an agent for the sellers of the property. The contract for sale on each item is a contract between the owner and the successful bidder.
2. CONDUCT OF AUCTION:
a. You must be at least 18 years old to bid.
b. Registration: You must register to bid in this sale.
c. To receive an online bidder number you must register through Proxibid and provide a valid credit card.
d. Invoices will be emailed to successful bidders within 24 hours of the close of auction and the credit card filed on registration will be charged for the sale price, buyers premium and sales tax (if applicable) of all won items.
e. Bidders are responsible for payment in full of all purchases, before removal.
f. Sales Tax: All sales are subject to state and/or local sales tax unless a signed exemption form is presented for our record at the time of purchase.
g. Buyer's Premium: A 15% buyer's premium applies to all purchases. That means that a surcharge of 15% will be added to the purchase price for each lot and paid by the winning bidder.
h. Payment by cash, Visa, MasterCard or wire transfer is acceptable.
i. Removal: All items are offered as is/where is.� Bidders are responsible for removal. Items may be removed on Wednesday, April 18th and Thursday, April 19th from 10am - 4pm. Items not removed by the stated time will be considered abandoned and accessed a $200 a day fee. Be prepared to bring hand trucks, forklifts, dollies or other equipment necessary for removal. No on-site help is available. Buyer authorizes Miceli Appraisers & Liquidators to release buyer's assets to any person in possession of a paid invoice.
j. Inspection: The shop will be open for your inspect of the assets on Thursday, April 12th from 10am-3pm.
k. This catalog is subject to additions and/or deletions up to, including and through bid close date. Auctioneer and seller reserve the right to group, reduce, add, or delete lots.
l. Miceli Appraisers & Liquidators reserve the right to accept or reject any bid. In the event of a dispute between bidders and/or auctioneer, the auctioneer shall have final discretion to determine the successful bidder.
m. Miceli, Appraisers & Liquidators reserves the right to add or withdraw lots for whatever reason.
3. NO WARRANTIES:
a. All items sold as-is, where is with all faults, if any. The information contained herein has been obtained from sources believed to be reasonably reliable. The auctioneer believes that each item has been carefully and accurately described, however, the auctioneer and owner make no warranties (either expressed or implied) or guarantees the accuracy of the information in this offering, or to the merchantability, correctness, description, fitness or condition of the items. Purchaser has examined the sale items and their locations and has performed such tests, as he/she deems necessary and appropriate.
b. Quantities: All counts are approximations based on actual counts, except where noted.
c. Sale items and title to the sale items are transferred to the purchaser without recourse or regress to the auctioneer, seller, owner or landlord.
a. By Bidding in this Auction Sale, you agree to abide by these terms as well as any others announced by the auctioneer.
b. Bidders hereby indemnify and hold harmless Miceli, Appraisers & Liquidators, trustee, secured creditor, auctioneer, and landlord, from all damages, claims or liabilities from any injuries caused to persons or property during inspection or during removal or from claims pertaining to the fitness or use of any items that has been purchased at auction.
c. Bid rigging is a crime: Auctioneer will immediately report illegal conduct by any person to the U. S. Attorney and Department of Justice for investigation and prosecution to the fullest extent of the law. Title 15, Section 1 of the U.S. Code provides any agreement among potential bidders not to bid against one another, or otherwise to dampen the bidding process, is a felony under federal law. The law provides for fines of up to $10 million per violation for a corporate offender, and $350,000 per violation for others, as well as imprisonment of up to three years.
d. All sales are final “ NO REFUNDS, RETURNS, OR EXCHANGES.
