Terms and Conditions for Brinkman Auctions
1) All Property is sold “As is, Where is” and we make no guarantees, warranties or representations, expressed or implied with respect to the property of correctness of the catalog, or other description of authenticity of physical condition, size, quality or rarity of the property or otherwise. Prospective bidders should inspect the property before bidding to determine condition, size, and whether or not it has been repaired or restored. Buyer hereby releases Brinkman Auctions, Northland Promotions, Inc. from and against any claim, demand, liability or expense of any kind arising out of or related to the Lot, expressly including without limitation any assertion of negligence (including negligent misrepresentation) condition, representation, or breach of warranty.
2) A Buyers Premium of 10% Live, 15% Absentee, Internet or Phone of Final Bid is Payable By the Buyers on All Lots. Bidder understands that they must pay the sum equal to 10% Live (ten Percent) or 15% Absentee/Internet (fifteen percent) on any article purchased at this auction, and that this fee will be automatically included in the final settlement figure, and will be subject to applicable taxes and license fees, and is payable without relief to Brinkman Auctions.
3) Buyers agrees to pay for all lots purchased on the day of sale either by United State Currency, Pre-Approved Check with Bank Letter of Guarantee, Cashiers Check, or Visa,/ Master Card, American Express. Credit cards not accepted on Vehicle purchases. In event of Buyer defaulting on purchase for any reason, Buyer agrees to pay Brinkman Auctions the full sum of both the buyer’s premium (15% of sale price) and seller’s commission (15% of sale price), This sum is due and payable without relief. Buyer also agrees to pay any court cost, attorney fees, storage, etc. incurred by Brinkman Auctions. This in no way releases Buyer from any and all financial responsibility regarding said purchase.
4) Upon the Auctioneer’s call of “SOLD”, title of the offered lot will pass to the highest Bidder acknowledged by the Auctioneer, subject to the conditions set forth here, and such Bidder thereupon (a) assumes full risk land responsibility therefore and neither the Seller nor Brinkman Auctions or its agents shall be responsible for the loss of, or any damage to any article due to the theft, fire, breakage or any cause whatsoever, however occasioned, (b) will sign a confirmation of purchase thereof, and (c) will thereupon pay the full purchase thereof. All property must be removed from our premises by the Purchaser at their expense not later than 72 hours following the completion of the sale, and if it is not so removed, a handling charge of 10% (ten percent) of the purchase price will be payable by the Purchaser per month, until its removed, with a minimum of 20%(twenty percent) for any property not so removed within 60 days after the sale. All sales final.
5) Shipping – Brinkman Auctions has made arrangements with an out-side (third party) shipping company. Buyers hereby agrees to hold harmless Brinkman Auctions from any damage or loss related to shipping of auction purchases.
6) All lots are sold subject to Minnesota Sales Tax and unless a resale number and completed exemption form are provided during registration.
7) The Auctioneer shall not be held responsible for any missed bids or bids unseen by the auctioneer or any of their agents.
8) The Auctioneer has the sole discretion to advance the bidding and may reject a nominal advance, should it in his estimation prove injurious to the auction. The auctioneer shall be the final judge in all bidding disputes and shall name a bidder as the purchaser.
9) All announcements made day of auction take precedence over any and all written or verbal statements.
By bidding on any item, the bidder shows acceptance of the terms of the auction & Auctioneer.
