NO ITEMS PURCHASED AT AUCTION MAY BE REMOVED FROM THE AUCTION FACILITY UNTIL APRIL 2, 2013. This is a working business being closed/relocated due to light rail expansion which makes this a unique situation for bidders. As indicated under the Payment Insturctions section of the auction listing, each successful bidder will be required to make a deposit of at least 25% toward their total purchases. The remaining balance (payment in full) is then due No Later than 4:00 PM on March 29th, 2013. The auction lots/items will continue to be in use after their purchase at auction. Again, this is a unique situation; the business will continue to operate until the latter part of March 2013. TO MAKE SOME ASSURANCES TO THE SUCCESSFUL BIDDERS AT AUCTION ? TriMet warrants that, from the date of purchase to the date of delivery, all fixtures, equipment and furnishings purchased through the Beaver Heat Treating auction will be kept and maintained in substantially the same condition in which they existed on the purchase date, ordinary wear and tear expected. If any fixture, equipment, or furnishing is damaged or otherwise not in substantially the same condition on the delivery date as it was on the purchase date, TriMet will refund the payment received from the buyer. If the parties dispute the condition of an item, the decision of an independent equipment specialist will be binding on the parties. All lots shall include such controls and control panels as are being used to operate the auction item on the date of the viewing, January 26, 2013. Some items, as specially noted in the lot description, are being sold without installation (e.g., piping and wiring, etc.), but the controls and control panels are included in those items if there are controls and control panels in use to operate that item on the date of the viewing, January 26, 2013. An On-Site preview of auction items will be held (see Preview Date and Times for further details). Bidders are strongly urged to take advantage of the On-Site preview to personally review/inspect all items being sold. Although we make every attempt to verify catalog descriptions, the auction catalog is meant as a guide only and ITS ACCURACY IS NOT GUARANTEED. Once an item is awarded to the successful bidder it is SOLD without exception to that bidder and payment in full in accordance with the auction terms and conditions is expected. Despite our efforts to avoid the removal of items from the auction after they have been advertised, it may become necessary to do so; therefore, TriMet and/or the auctioneer will reserve the right to withdraw units at anytime. Auctioneer reserves the right to reject a bidder?s registration application and/or bids for any reason at their sole discretion without prior contact to the bidder. CIA is providing internet pre-bidding and live bidding as a service to the bidder. Bidder acknowledges and understands that this service may not function correctly the day of the auction. Under no circumstances shall the bidder have any kind of claim against CIA or anyone else if the internet service fails to work correctly before or during the auction. CIA will not be responsible for any missed bids from any source. CIA reserves the right to withdraw or re-catalog items in the auction.
