Seller reserves the right to sell the property prior to Auction. The seller is not obligated to sell the property unless the published minimum reserve price has been met. Seller retains the right to accept or reject a final bid that is less than the minimum reserve price. 8. Auctioneer will accept absentee bids prior to the live auction. There is a 15% buyer's premium in this auction for cash sales, an additional 2.5% for credit cards. Proxibid online bidders will pay an additional 3%. 12. Buyer acknowledges that the Auctioneer represents the Seller and that the payment of the buyer's premium does not constitute relation of dual agency. 13. Auctioneer Participation: A commission of 3% will be paid by the Auction Company to any Auctioneer who provides a prospect (registered bidder) who successfully wins a lot. On the fall of the auctioneer's hammer, title to the offered lot or article will pass to the highest acknowledged bidder, who thereupon (a) immediately assumes full risk and responsibility, therefore, (b) will immediately sign a confirmation of the purchase therefore, setting forth his name and address, and (c) will immediately pay the full purchase price therefore. If the foregoing conditions or any other applicable conditions herein are not complied within addition to other remedies available to Auctioneers and the Consignor by law (including without limitation the right to hold the purchaser liable for the bid price), Auctioneers, at its option, may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser, or (b) resell the property, either publicly or privately, for the account and risk of the purchaser, and in such event the purchaser shall be liable for the payment of all deficiencies plus all costs, including warehousing, the expenses of both sales, and Auctioneers commission at its regular rates and all other charges due hereunder.
