Terms Of Sale
Registration: You must register at the auction office with picture identification and obtain a bidding number to bid or buy at the auction. Buyers must be at least 18 years of age in order to bid. We will require your name, address, phone number, and driver's license number in order to register. This information will not be sold or transferred. There is no charge for registration and it is better to have a number and not use it than to not have one if you need it. Do not allow anyone to use your bidder number unless you are prepared to pay for the purchase. All documents will be completed in the bidder's name only. If you leave the auction early, please turn in your number at the office or take it with you. You are responsible for any purchases made with that number.
Internet Bidding: If you plan on bidding through the internet, you must register with Proxibid and follow their directions to become an internet bidder.
Lots: This will be a cataloged auction. Catalogs will be available online as well as auction day. If you have specific questions about an item, please see one of the auction employees and give them the lot number prior to the start of the auction. They are here to assist you with any questions.
Preview: It is the buyer's responsibility to preview and inspect the items prior to bidding. The auction will be held in a ballroom setting at the auction site, and all lots will be sold by digital image. It is important that you preview, as everything will be sold "AS IS and WHERE IS" in its present condition, with no guarantees or warranties, expressed or implied, statutory or otherwise of any nature whatsoever. The Auctioneers assume no responsibility for any liability once the bid is accepted. ALL SALES ARE FINAL! Each sale is complete when the auctioneer says "SOLD" or at the fall of the gavel. Risk or loss for any reason passes to the buyer at this time. It is the buyer's responsibility to secure their own purchases and remove all items in the allotted time.
Removal/Shipping: Removal and shipping is the responsibility of the buyer. Guard and protect your purchases. Small items may be loaded in your car after winning the bid, since we record all purchases. All lots must be removed within 5 days following the auction, unless special arrangements are made with the owner. Ownership of any ASSET OR LOT remaining on the subject property on Saturday, May 17th will revert to the secured party. Any contractors using equipment for removal of purchases must be bonded and insured. In addition, any employee moving equipment must be covered by Worker's Compensation Insurance, and demonstrate proof of this insurance.
Payment: The total of the purchase price is to be paid in full on auction day by cash, cashier's check, approved company or personal checks, or Visa/MC. Buyers unknown to us must be prepared to supply bank officer's name and phone number to verify funds or present a Bank Letter of Guaranteed Payment to the office. All checks shall be made payable to "Steve Van Gordon Company, LLC." NO BUYER'S PREMIUM WILL BE CHARGED ON THIS AUCTION. A 3% fee shall be charged on each sale for Visa and MasterCard payments, governmental purchase orders, or unauthorized delayed payment. For internet purchases, the fee will be 6%.
Announcements: Please listen to the auctioneer for special announcements. The catalog has been prepared only as a guide based on information from the Consignor, and the accuracy cannot be guaranteed or warranted by the Auctioneers. Any announcements made by the Auctioneer on auction day will take precedence over the contents of the catalog.
Disputes: We digitally record every auction. If you feel there is a discrepancy, please stop the Auctioneer immediately. If the Auctioneer moves to the next lot number, the recording will be available at the end of the auction and will be the final authority. The Auctioneer will settle any dispute with respect to tie bids.
Hold Harmless: Every person at the auction site before, during, and after the auction acknowledges that he/she is there at his/her own risk with notice of the condition of the premises. No person shall have any claim against the Auctioneers, their agents, employees, sellers, owners, or principals for any injuries sustained or for any damages to or loss of property which may occur from any causes whatsoever.
Bid Rigging: Bid rigging is a felony. If any person asks you to not bid against them, or if you witness any tampering or vandalism, report all such actions to the auction staff immediately. It is a federal crime and is punishable by imprisonment and fines.
Titled Vehicles/Trailers: If vehicles are sold, the seller will mail all vehicle/trailer documents via certified mail to the buyers after verification that the full amount of monies due have been paid in full to the auction company.
REMOVAL:
Everything must be completely removed from the auction site within 5 days following the auction.
